My last word on the debate...

I will offer no more words of wisdom or idiocy (depending on your viewpoints) on this debate. This includes within the comment threads, since apparently the minions on the left are pretty much only interested in rehashing the "good people on both sides" hoax and dishonestly demanding that the President won't condemn white nationalists.

I first want to point out that Donald Trump has been in four Presidential debates so far, and has seemingly had to deal with some last second "bombshell" in each of them. From the hot mike issue with Access Hollywood, to the so called non-release description of his tax returns just prior to last nights debate, there has usually been at least one question set aside designed specifically for Trump having to explain himself out of something. Neither of his opponents have ever had to deal with this.

Next I want to point out that we are in the middle of a world-wide pandemic, the likes of which has not been witnessed in our life times. At the same time, we are going through an extremely violent social unrest that has bitterly divided the nation. On top of all that, we have an economy that has has had to bear the brunt of both of these things. Donald Trump has been President for nearly four years, while Joe Biden has been out of politics for that same period of time. 

So this was a debate that clearly provided the challenger with the upper hand. Approximately half the questions were forgone to put the President on his heels, and provide an opportunity for Joe Biden to attack (in areas where he has very little to lose). By all accounts, if this was a race, Trump was hypothetically saddled with having to wear ankle bracelets, while having his right shoe lace tied to his left... at least if he allowed it to play out by conventional rules. 

So if people are shocked or surprised that Trump turned this into a knock down drag out brawl instead of engaging in a straight forward debate on the subjects being presented, then they probably don't understand Trump. As much as Trump is being criticized by people over his bullying tactics and obvious attempts to play alpha dog over the events, the question is whether or not this was the lesser of two unappealing strategies. 

Given how much it was apparent (even to people on the left) that Trump ended up debating both Wallace and Biden, imagine the scenario where Wallace would be provided with complete control and where the President would simply be asked to stand back and take attack after attack from two fronts on how many people have died from Covid, how it has to be his fault that people are rioting, or that the draconian lockdowns from our blue states creating economic hardship is all his fault. That would not have likely gone all that well for the President considering the circumstances.

But now certain things have changed. Expectations are different and if Biden shows up for the next debate, it might just be the President (not Biden) who might be provided with the benefit of lowered expectations. There should be no more talk of tax returns, and eventually we will get into subjects more favorable to Trump, such as explaining specific economic policies moving forward, trade deals, and foreign policy where Trump has just been nominated for his third Nobel Peace prize.  

If I was Donald Trump I would open debate two with a firm statement openly denouncing all hate groups and listing them by name (including antifa). Then he should challenge Joe Biden to do the same and denounce all groups (including antifa). That would put that issue to rest and place Biden on the defensive (because he will not denounce antifa in spite of the damage they have caused to the country). 

I will end with how I began all of this. Nobody won this "debate" because it really was never a "debate". It was clash of styles, a clash of personalities, and clash of ideologies. Both men had good moments and bad moments. But at the end of the day it was little more than a street fight and you can all determine for yourself who came out with the bloodier of noses.

Brandenburg's language about "imminent lawless action" produced the "Brandenburg Test," which requires that in order to punish the speaker, the speech is:

directed to inciting or producing imminent lawless action, and
likely to incite or produce such action.
This "imminent lawless action" test was later reaffirmed by the Supreme Court in Hess v. Indiana, 414 U.S. 105 (1973), as the Court refused to punish speech that advocated illegal action which may take place in the indefinite future.

After preying heavily on the elderly in the spring, the coronavirus is increasingly infecting American children and teens in a trend authorities say appears fueled by school reopenings and the resumption of sports, playdates and other activities.

Children of all ages now make up 10% of all U.S cases, up from 2% in April, the American Academy of Pediatrics reported Tuesday. And the Centers for Disease Control and Prevention said Monday that the incidence of COVID-19 in school-age children began rising in early September as many youngsters returned to their classrooms.

About two times more teens were infected than younger children, the CDC report said. Most infected children have mild cases; hospitalizations and death rates are much lower than in adults.

Dr. Sally Goza, president of the American Academy of Pediatrics, said the rising numbers are a big concern and underscore the importance of masks, hand-washing, social distancing and other precautions.

“While children generally don’t get as sick with the coronavirus as adults, they are not immune and there is much to learn about how easily they can transmit it to others,’’ she said in a statement.

America is hurting, really hurting. Thousands of people are dying every week. Jobs lost. Lives thrown asunder. The West on fire. Our international standing at the lowest point I can remember. We need leadership. We need empathy. We need unity. We need justice. We need hope.

Who won and lost tonight in a horse race sense, I don't even want to address. Frankly, I don't give a damn. This was a sad, sad, sad night for this nation that I love with all my heart. This is a moment to mourn what we have lost, and are in danger of losing. I don't want to hear from the pundits, I want to hear from the people. I want to hug all of you in a warm embrace and say, we can, we must be a helluva lot better than this.

We need to dig deep into our moral character. We need to look at ourselves in the mirror and into the hearts of our neighbors and fellow citizens. We need to embrace a patriotism that is broad, inclusive, and just. We know bullies. We know when racists refuse to denounce racism. We know when autocrats try to undermine democracy.

There will be an election. And then there will be a future. No president is bigger than the nation. The American people have a voice. And after tonight, I sense millions are eager to turn their yelling at the television into marking their ballots.

When your response to violent left-wing groups trashing cities and killing people is "hey, what about this little band of online loudmouths nobody ever heard of before?" you are mainstreaming political violence. You're explicitly equating it with jerks writing nasty tweets.

Other Senate Republicans on Capitol Hill largely sought to distance themselves from the president’s remarks at the debate, and urged Mr. Trump to clearly denounce white supremacy.

Senator John Thune of South Dakota, the No. 2 Republican, said Mr. Trump should “clear it up.” Senator Bill Cassidy, Republican of Louisiana, told reporters “he should unequivocally condemn white supremacy.” Senator Susan Collins, Republican of Maine, told reporters “it was the least educational debate of any presidential debate I’ve ever seen” and said that Mr. Trump should “absolutely” condemn white supremacy.

So on Wednesday Mr. Trump addressed the issue, retreating from his debate night comments that the Proud Boys, a far-right group that has endorsed violence, should “stand by.” Speaking to reporters as he left the White House for a campaign trip to Minnesota, he said: “I don’t know who Proud Boys are, but whoever they are, they have to stand down, let law enforcement do their work.”

But the president once again quickly added that left-wing violence was “the real problem” and falsely accused former Vice President Joseph R. Biden Jr. of refusing to say the words “law enforcement” during Tuesday night’s presidential debate.

The Proud Boys, a far-right extremist group, has received a flood of new members in the hours since President Donald Trump refused to condemn the group on television during the first presidential debate Tuesday evening.

Moderator Chris Wallace, a Fox News host, repeatedly asked if the president would condemn white supremacists and militia groups. When Democratic candidate Joe Biden chimed in with the Proud Boys as an example of a group Trump might disavow, Trump at first interrupted Wallace in a back-and-forth, then responded: “Proud Boys, stand back and stand by.”

The remark immediately sparked enthusiastic responses from members of the male-only group, which the Southern Poverty Law Center said has “affiliations with known extremists.”

Following the president's comments, the group, founded by Vice cofounder Gavin McInnes, celebrated on the semi-private social media networks that they’ve been forced to inhabit after Facebook and Twitter banned them in 2018. They put the president’s words on their logo, posted a cheering video, and began to sell T-shirts saying “stand down stand by.”

I caught another lie by Thecoldheartedtruth.

Prior to the Affordable Care Act (ACA), having a pre-existing health condition, such as a severe respiratory illness, made it harder or even impossible for people to get and keep private health insurance in the individual market. Coverage people bought on their own in this market was “medically underwritten” in most states. That meant applicants had to answer questions about their health status and history and, based on their answers, could be turned down, charged more, or offered a policy that permanently excluded their health condition. Job-based group health plans could also exclude coverage for pre-existing conditions for up to one year. However, people could change jobs and move to a new group health plan without a new exclusion period as long as they didn’t have a gap in coverage longer than 2 months. And even before the ACA, employers could not deny eligibility for group health benefits or charge people more for group health benefits based on health status.

Since 2014, the ACA generally has made it illegal for private insurance to exclude coverage for pre-existing conditions or to deny coverage or charge higher premiums on that basis. In November, the Supreme Court will hear oral arguments on California v Texas, a lawsuit brought by Republican state officials and supported by President Trump, that seeks to invalidate the ACA entirely. If the ACA is overturned, federal law protection for people with pre-existing health conditions would end. While some states have moved to enact similar insurance market reforms since the lawsuit was filed, tens of millions of people residing in many states – including Texas and most of the other plaintiff states that have not – could again be subject to medical underwriting. And, even in states that have moved to assure pre-existing condition protections, it would be difficult to avoid a premium “death spiral” with federal subsidies to make coverage more affordable and encourage currently healthy people to sign up.

How would a pre-existing condition exclusion period work for COVID-19?

The rules about so-called pre-existing condition exclusions varied by state. In nearly all states, in addition to denying coverage or surcharging premiums, insurers could impose permanent pre-existing condition exclusions for any condition already diagnosed and disclosed at the time of application. That means claims for otherwise covered services under the policy would be denied for the pre-existing condition.

Rhodes was driving around South Texas, getting ready for them. He answered his phone. “Let’s not fuck around,” he said. “We’ve descended into civil war.”

It was a Friday evening in June. Rhodes, 55, is a stocky man with a gray buzz cut, a wardrobe of tactical-casual attire, and a black eye patch. With him in his pickup were a pistol and a dusty black hat with the gold logo of the Oath Keepers, a militant group that has drawn in thousands of people from the military and law-enforcement communities.

Rhodes had been talking about civil war since he founded the Oath Keepers, in 2009. But now more people were listening. And whereas Rhodes had once cast himself as a revolutionary in waiting, he now saw his role as defending the president. He had put out a call for his followers to protect the country against what he was calling an “insurrection.” The unrest, he told me, was the latest attempt to undermine Donald Trump.


Over the summer, Rhodes’s warnings of conflict only grew louder. In August, when a teenager was charged with shooting and killing two people at protests over police brutality in Kenosha, Wisconsin, Rhodes called him “a Hero, a Patriot” on Twitter. And when a Trump supporter was killed later that week in Portland, Oregon, Rhodes declared that there was no going back. “Civil war is here, right now,” he wrote, before being banned from the platform for inciting violence.

By then, I’d spent months interviewing current and former Oath Keepers, attempting to determine whether they would really take part in violence. Many of their worst fears had been realized in quick succession: government lockdowns, riots, a movement to abolish police, and leftist groups arming themselves and seizing part of a city. They saw all of it as a precursor to the 2020 election.

As Trump spent the year warning about voter fraud, the Oath Keepers were listening. What would happen, I wondered, if Trump lost, said the election had been stolen, and refused to concede? Or the flip side: What if he won and his opponents poured into the streets in protest? The U.S. was already seeing a surge in political violence, and in August the FBI put out a bulletin that warned of a possible escalation heading into the election. How much worse would things get if trained professionals took up arms?

Methodological transparency is always important, but the burden is even higher if a firm uses nontraditional methods and produces systematically different results from other firms.

But over the last few days, these firms have done something unusual: They’ve shown some pretty good results for Mr. Biden. Rasmussen showed Mr. Biden up eight points nationwide, one of its largest leads for him this cycle. It also showed Mr. Biden up 14 points in New Hampshire, a great result for him by any measure.

Rasmussen has occasionally shown some decent results for Mr. Biden, including a 10-point national lead in July and a lead in Ohio in September. But the Trafalgar Group has essentially never shown any good results for him. Its results lean so consistently to the right that I usually nudge its results about five or six points to the left in my head.

Yet over the last few days, Trafalgar has Biden ahead in Pennsylvania, Michigan and Wisconsin. If even Trafalgar thinks Mr. Biden’s ahead in those key states, things are looking rough for the president.
