Republican Claudia Tenney back in the lead after revision of final count
UPDATE: Judge orders all counties to provide a FINAL final count by 4:00 today and much like a math professor he is also demanding that all counties "show their work" by producing any notes, spreadsheets, or any calculations as to how and why vote counts have been changed.
The order is being described as "scathing" and it appears to suggest that the judge believes that at least some counties are attempting to hold back information or otherwise attempting to make calculated last minute changes to alter the outcome. He has also produced a 48 hour deadline on any new legal challenges to be considered.
He is apparently not holding another hearing until December 7th, which is actually the deadline for NY certification. So it appears that he is fed up with dealing with the counties, plans no more in person hearings allowing them to bicker and argue regarding who is more incompetent, and it certainly looks like that court date will likely be to announce a final decision.
The Judge is supposed to have some sort of hearing today and is tasked to rule on ballots that cannot be found and others that have no explanation as to why they were challenged. Meanwhile, the vote total flipped back to the Republican, who now leads by 12 votes in the unofficial final tally.
As of today, the Tenney campaign is pushing for the counties to certify the results, while Brindisi is hoping to delay the process for at least 24 hours. There is some argument that Brindisi can still ask for a full recanvassing/recount "after" the votes have been certified. Tomorrow is December and apparently we might be "starting" a recount for an election that is nearly four weeks old?
Anyone who still feels that our problems with elections have more to do with the ability of the public to properly vote than the ability of our election officials to properly count is missing the boat. The election reform we need right now has to do with what happens "after" the votes have been cast, not before.

That is the inherent problem with election lawsuits that might suggest fraud or tampering. Because of the timing between the election and certification, you have no time for what a normal lawsuit would go through.
At this point in a normal lawsuit, the plaintiff would simply be looking for grounds to move the case to discovery where they would either be able to (or not be able to) show evidence of the claims.
But there simply isn't time for a discovery phase in an election suit such as this. You need to come with the proof in hand. Nearly impossible when you have no access to the materials, witnesses, and such required to prove it.
Imagine if normal litigation required you to prove what you suspect "prior" to bringing a suit. Forget the idea of subpoenas and such. They would become irrelevant as defendants would refuse to provide information, there would be no way to get that information, and then Judges dismissed the claims due to lack of evidence.

Arizona certified its results Monday, giving President-elect Joe Biden a win in yet another state where President Trump has contested the election. Trump allies have pledged to continue court challenges in the state.
The action came as Biden forged ahead with plans for his presidency, announcing a committee to organize his Jan. 20 inauguration and formally unveiling his economic team. Biden was also set to receive his first President’s Daily Brief, a classified compilation of information from intelligence agencies.

Rep. Anthony Brindisi, D-N.Y., and his supporters have been claiming for days that their man has pulled ahead of ex-Rep. Claudia Tenney, R-N.Y., for the first time in the "long count" of their contest in New York's 22nd District (Utica).
Based on the last count from the eight counties in the upstate district, Brindisi on Wednesday proclaimed himself the winner by 13 votes on Twitter.
Not so, a source close to the Tenney team told Newsmax on Sunday.
WHAM Radio talk show host tweeted Sunday afternoon:
"After an audit and correction by the Herkimer County Board of Elections, Claudia Tenney leads Anthony Brindisi by 13 votes in the contest to represent NY-22 in Congress."
Amid cries of "fake news" from the Brindisi camp, a source close to Tenney explained to us that a letter from an election official in Herkimer County states:
"There were a number of errors in the initial spreadsheet which included, among others, a transposition or transpositions of numbers and a duplicate entry of the vote from one district in another district and a corresponding failure to enter the actual vote totals from the district where the duplicate entry occurred."
The outcome of the correction in Herkimer County and resulting change in the vote totals will be known Monday.
That same day, lawyers for Tenney and Brindisi will arrive in an Oswego County courtroom where the fate of their contest will be decided.
State Supreme Court Justice Scott DelConte will hear challenges on absentee ballots and affidavits concerning election integrity from both sides for two days. He is expected to rule Wednesday whether or not a recount needs to be held.

A close female relative and I had a conversation recently. She was making conciliatory verbal gestures, in effect, saying that if everyone who supported Trump admits he lost, agrees they were wrong, and that Trump was evil, we can all move on amicably.
I responded, very calmly and dispassionately, which I was able to do because I was expecting this conversation, more or less as follows.
Using game theory, it has been determined that the proper way to respond to defection from optimal behavior between two parties, is to match any bad behavior by equal retaliation. Acquiescing in bad behavior without consequences simply gets you more of it.
So, the only rational rational response for Trump supporters, after the last four years is to respond to Biden exactly as Trump was treated:

First, no one who voted for or supports Trump will recognize Biden as legitimate. Second, everyone who voted for Trump will believe and continue to proclaim that the election was stolen, in this case with far more factual basis. Third, Biden will not be given any deference or respect due to his office, but will be given only contempt and profane disrespect. Fourth, there will be no prospect of cooperation but only opposition, in every lawful way, to everything he says, does, or proposes, all day, every day, until he is gone.
At some future date reconciliation may be possible. But not until the last four years has been repaid in full.
And the foregoing is on the presumption that Biden will be sworn in as President, which he should not be, and which may not happen.
