What's going on in the wacky world of election lawsuits?

Federal Judge Orders Voting Machines In Three Georgia Counties to be Subject to Expert Examination in Powell Lawsuit
“Plaintiffs contend that Union County officials have advised that they are going to wipe or reset the voting machines of all data and bring the count back to zero on Monday, November 30.
To the extent Plaintiffs seek a temporary restraining order to preserve the voting machines in the State of Georgia, and to prevent any wiping of their data, their motion is granted. Defendants are ordered to maintain the status quo and are temporarily enjoined from wiping or resetting any voting machines until further order of the court.”
Pennsylvania Supreme Court dismisses challenge to mail-in ballot procedures, vacates halt to certification
“Petitioners failed to act with due diligence in presenting the instant claim. Equally clear is the substantial prejudice arising from Petitioners’ failure to institute promptly a facial challenge to the mail-in voting statutory scheme, as such inaction would result in the disenfranchisement of millions of Pennsylvania voters.
Pennsylvania Republicans call for withdrawing election certification
The 26 GOP lawmakers announced the resolution on Friday, citing election law compromises, voter irregularities, and unconstitutional legislative decisions in their reasoning for why the secretary and governor of Pennsylvania should move to "withdraw or vacate the certification of presidential electors and to delay certification of results in other statewide electoral contests voted on at the 2020 General Election."

The first decision surprised some people, because the general "conventional wisdom" is that any lawsuit by Powell is little more than barking at the moon. I doubt that they can prove what they are "needing" to prove, but I like the fact that a Judge will at least allow an examination either way.

The Pennsylvania is not a surprise as that Court is mainly liberal and was expected to rule against the claim. The court is not denying that there might be issues with the mail-in voting (a previous Judge stated that there was a good chance that the plaintiffs would prevail on merits). What they are saying is that there isn't time to argue the point before the safe harbor period. This was a very similar argument that the USSC used to overturn (rather than remand) the FSSC ruling back in 2000 (bumping up against safe harbor dates).

The legal minds at Legal Insurrection do not feel that the USSC will take this up, so that is sort of why you see the legislative branch attempting (likely in vain) to get involved.

While Dominion Voting Systems is not named as a defendant, on Wednesday, November 25, 2020, Sidney Powell released what appears to be a very rough draft of a lawsuit against the Republican governor and secretary of state of Georgia alleging a bizarre election fraud conspiracy that—were it possible—would necessarily require the collaboration of thousands of participants, including state officeholders, bipartisan local elections officials, thousands of volunteer Election Day poll watchers in thousands of locations across the state of Georgia, federal and state government technology testing agencies, private elections service companies, and independent third-party auditors. This quite simply did not occur.

Dominion Voting Systems is the gold standard for transparent and accountable voting equipment. The allegations included in the draft complaint are baseless, senseless, physically impossible, and unsupported by any evidence whatsoever. We stand with the state and local elected officials and bipartisan election volunteers that this suit maliciously maligns.

In Powell's error-filled document, she repeats a number of baseless allegations about Dominion Voting Systems, which she has made in public since Election Day.

The allegations about DVS most relevant to the election outcome in Georgia are that votes tallied on a Dominion vote tabulator were somehow manipulated on a statewide basis to elevate the count in favor of the Democratic presidential candidate. It is important to understand that this is not possible—not on a machine-by-machine basis, not by alleged hacking, not by manipulating software, and not by imagined ways of "sending" votes to overseas locations.  But even if it were possible, it would have been discovered in the statewide handcount of votes.

Dominion's systems are secure as certified by the U.S. Election Assistance Commission (EAC). In fact, all voting systems must provide assurance that they work accurately and reliably as intended under federal U.S. EAC and state certification and testing requirements. Further, Dominion source code is verified and secure. Third-party test labs chosen by the bipartisan U.S. EAC and accredited by the National Institute of Standards and Technology (NIST) perform complete source code reviews on every tabulation system that is federally certified in the U.S.

Every vote from a Dominion device in Georgia is documented on an auditable paper trail and creates a verifiable paper ballot available for hand-counting. In fact, the Georgia handcounts, independent audits, and machine tests have all repeatedly affirmed that the machine counts were accurate.

In addition, Powell makes a number of allegations that go beyond Dominion's role in Georgia's elections—which is only to provide the ballot tabulation systems. For the record, again, Dominion does not develop voter-registration systems, poll-books, signature verification software, or provide vote-by-mail printing. These parts of the voting process are instead supported by other companies and controlled by the state and local officials who run elections in hundreds of thousands of voting places across the country.

These assertions in the Powell filing are non-sensical and unsupported by any presentation of evidence. However, to respond to some of her specific assertions about Dominion:

Dominion was not "founded by oligarchs and dictators." It was founded in Toronto, Canada, and it is now a proud nonpartisan American company. Dominion has attested to its ownership—under penalty of perjury—to local, state, and federal agencies, including the Committee on Foreign Investment in the United States, which includes all U.S. national security agencies.Dominion is not, and never has been, owned by Smartmatic. Neither has Smartmatic ever been a subsidiary of Dominion, as the complaint asserts. Dominion is an entirely separate company—they do not collaborate in any way and have no affiliate relationships or financial ties. Dominion does not use Smartmatic. These are all facts verifiable in the public record as well as in regulatory and legal filings.Dominion has no ties to the Venezuelan government, nor any other foreign government, including China and Iran. Dominion has never participated in any elections in Venezuela and has no connection or relationship with the now deceased former Venezuelan dictator Hugo Chavez. Other companies have serviced elections in Venezuela, but Dominion is not one of them.Dominion does not have operations in Germany including an "Office of the General Counsel."Dominion Voting Systems are in fact auditable—and are audited and tested regularly by multiple government agencies and independent third parties. All electronic devices used in the U.S. must be designed to be audited.Dominion's system does in fact include a paper ballot backup to verify results. In fact, thousands of elections officials in Georgia just completed the largest vote recount in American history using the paper ballots produced by Dominion devices.Dominion's system cannot be manipulated by a technician in the way Powell alleges. This has been confirmed by the government agencies that have certified Dominion equipment.Despite repeated counts and audits, there is no evidence of any kind that any voting system deleted, lost, or changed votes in Georgia, or in any of the other 28 states that use Dominion devices. Certifications and audits have instead shown the accuracy, transparency, and reliability of Dominion's systems. The federal government agency that oversees U.S. election security verified that there is no evidence that this election was in any way compromised. In fact, they have called it the most secure election in American history.Servers that run Dominion software are located in local election offices, and data never leaves the control of local election officials. There were no "glitches" with Dominion's voting systems, and no unauthorized or last-minute software updates occurred. There were no "data breaches" of Dominion software by anyone, let alone rogue foreign actors.Human errors did occur in some counties but were resolved quickly by county officials before the canvass process.Votes are not processed outside the United States. Votes are counted and reported by county and state election officials—not by Dominion, or any other election technology company.Election safeguards—from testing and certification of voting systems to canvassing and auditing—prevent malicious actors from tampering with results.

Sidney Powell's and Scott asshole's wild and reckless allegations are not only demonstrably false, they have led to stalking, harassment, and death threats to Dominion employees. This criminal activity has been duly reported to the appropriate law enforcement agencies, and we intend to hold Ms. Powell, and those aiding and abetting her fraudulent actions, accountable for any harm that may occur as a result.

WASHINGTON (AP) — Dr. Scott Atlas, a science adviser to President Donald Trump who was skeptical of measures to control the coronavirus outbreak, is leaving his White House post.

A White House official confirmed that the Stanford University neuroradiologist, who had no formal experience in public health or infectious diseases, resigned at the end of his temporary government assignment. Atlas confirmed the news in a Monday evening tweet.

Atlas joined the White House this summer, where he clashed with top government scientists, including Dr. Anthony Fauci and Dr. Deborah Birx, as he resisted stronger efforts to contain the COVID-19 pandemic that has killed more than 267,000 Americans.

I nominate S.Scott Asshole to replace Scott Atlas, who has no formal experience in public health or infectious diseases, but because he's been linked to Real Clear Politics and quoted on television endorsing Trump. Being a loyalist is the most important qualification for the lame duck President!

GALLUP:
Biden's Favorability Rises to 55%,
Trump's Dips to 42%

October 30
Biden's favorability is up six points to 55% in postelection reading
Trump's favorability has edged down three points to 42% over same period

Democratic Party viewed favorably by 45%;
Republican Party, by 43%

WASHINGTON, D.C. -- President-elect Joe Biden's favorability rating has risen six percentage points to 55% since the election compared with his final preelection reading. At the same time, President Donald Trump's favorability has edged down three points to 42%.

Biden's current rating is the highest it has been since February 2019, two months before he declared his candidacy for president, when it was 56%. Trump's latest favorability falls short of the highest of his presidency, 49% in April, during the initial stages of the coronavirus pandemic.

....The increase in Biden's favorability between Gallup's final preelection and first postelection readings is driven by independents and Republicans, whose positive ratings of Biden grew from 48% to 55% and 6% to 12%, respectively. Democrats' nearly unanimous positive ratings remained constant.

Trump's slightly lower postelection favorable rating is owed more to Republicans than independents or Democrats. Republicans' rating of the president fell six points to 89%, while it was essentially unchanged among independents and static among Democrats.

Since 2000, the winning presidential candidate's favorability ratings have increased slightly after the election. In 2000, when George W. Bush was not declared the winner until several weeks after Election Day, neither he nor Al Gore enjoyed an initial postelection bump. Yet, after the Supreme Court's Dec. 12 decision in Bush v. Gore determined Bush had won reelection, his favorability rose four points.

Additionally, since 2000, the winner's postelection favorability reached the majority level in every election except 2016, when Trump was the most personally unpopular presidential candidate in Gallup polling history. Biden's six-point increase in favorability this year is in line with those for other presidents and presidents-elect.

The pattern for losing presidential candidates is mixed. Some, including John McCain in 2008 and Mitt Romney in 2012, had significantly higher favorable ratings after the election. (McCain's showed the greatest increase: 14 points.) Hillary Clinton's favorability was unchanged after the 2016 election, and there is no reading for John Kerry until July 2005, by which time his favorability had fallen 10 points. Trump's three-point postelection decline is unique over the past six presidential election cycles.

LONDON – Deaths from malaria due to disruptions during the coronavirus pandemic to services designed to tackle the mosquito-borne disease will far exceed those killed by COVID-19 in sub-Saharan Africa, the World Health Organization warned on Monday.

More than 409,000 people globally – most of them babies in the poorest parts of Africa – were killed by malaria last year, the WHO said in its latest global malaria report and COVID-19 will almost certainly make that toll higher in 2020.

“Our estimates are that depending on the level of service disruption (due to COVID-19) … there could be an excess of malaria deaths of somewhere between 20,000 and 100,000 in sub-Saharan Africa, most of them in young children,” Pedro Alsonso, director of the WHO’s malaria program, told reporters.

“It’s very likely that excess malaria mortality is larger than the direct COVID mortality.”

The heat has been more notable than the bush fires at this point, with Sydney seeing back-to-back days with temperatures exceeding 104 degrees (40 Celsius) over the weekend, a feat that had not been accomplished during the month of November in 160 years of record-keeping.
Sydney also saw its hottest November night on record, with the temperature dropping to 77.5 degrees (25.3 Celsius) on Sunday. In the afternoon, the temperature reached 108.7 degrees (42.6 Celsius) as fire danger reached extreme levels in southeastern New South Wales.

Trump Steps Up Fundraising In Aftermath of Defeat
6:39 am EST
“President Trump has raised about $170 million since Election Day as his campaign operation has continued to aggressively solicit donations with hyped-up appeals that have funded his fruitless attempts to overturn the election and that have seeded his post-presidential political ambitions,” the New York Times reports.

“Instead of slowing down after the election, Mr. Trump’s campaign has ratcheted up its volume of email solicitations for cash, telling supporters that money was needed for an ‘Election Defense Fund.’ In reality, the fine print shows that the first 75 percent of every contribution currently goes to a new political action committee that Mr. Trump set up in mid-November, Save America, which can be used to fund his political activities going forward, including staff and travel. The other 25 percent of each donation is directed to the Republican National Committee.”

White House Planning a Dozen Indoor Holiday Parties
6:30 am EST
Washington Post:
“While many public health professionals have asked Americans not to congregate in large group settings and avoid travel over the holidays because of the coronavirus pandemic that has killed more than 266,000 Americans and infected 13 million more, the White House is expected to throw more than a dozen indoor parties, including a large congressional ball on Dec. 10, officials say.

“The parties will be paid for by the Republican Party, a person with knowledge of the planning said, and will cost millions of dollars.

“The president and the first lady are determined to have a final holiday season in the White House, officials said, and concerns about spiking cases and deaths across the country have not stopped the events. Many of the administration’s supporters have taken a skeptical view of the restrictions over the virus and are choosing to attend.”

Even Scott needs to wake up

PRESIDENT TRUMP’S Sunday Fox News rant ranks as one of the most dangerous of his presidency, and that is saying something. Mr. Trump issued claim after incoherent claim about vote rigging — machines switched thousands of votes, dead people voted, mail-in ballots were “phony,” poll watchers “weren’t allowed.” The United States just conducted probably the most secure, transparent presidential vote in its history; Mr. Trump calls it “the most messed-up election we have ever seen.” Proving there is no core national institution he will not besmirch, Mr. Trump attacked the judicial system for failing to ratify his lies and suggested that the Justice Department and the FBI are in on the conspiracy.

Either the president is delusional, or he is willing to knowingly tear down the democracy to deny that he is a loser. Either way, everyone else in a position of trust has a responsibility to defend the nation’s democratic system against Mr. Trump’s sustained assault. Some Republicans, mostly at the state and local levels, have done so, at times under extreme public scrutiny, counting the votes and refusing to manipulate the electoral process to overturn the popular will. For conscientiously overseeing the vote in his state — and standing up for its integrity against baseless attacks from Mr. Trump and the state’s two U.S. senators — Georgia Secretary of State Brad Raffensperger and his family have received threats. He and other election officials have had to accept security details.

“It’s time to stand up and be counted,” Mr. Raffensperger said. “Are you going to stand for integrity? Or are you going to stand for the wild mob? You wanted to condemn the wild mob when it’s on the left side. What are you going to do when it’s on our side?”

The response of most national Republican “leaders” has been to sit on the sidelines, or worse. Three weeks after the major networks called the race for President-elect Joe Biden, Sen. Roy Blunt (R-Mo.) refused Sunday to refer to Mr. Biden as president-elect, arguing that the label is not “significant.” He managed to admit that the election was not “rigged,” but he also claimed that “there may have been ballots that shouldn’t have been cast” in Georgia and that “there were some things that were done that shouldn’t have been done. And I think there was some element of voter fraud.”

The label matters, and so does GOP senators’ endorsement of the fiction that fraud and irregularities are a substantial problem. Should Mr. Trump persuade millions of Americans that the voting system is corrupt, he could inaugurate an era of dangerous instability; a future candidate in a closer election might succeed in overturning a fair vote by exploiting the doubts and leveraging the fear that the president has instilled.

For weeks, Republicans dodged by saying Mr. Trump was entitled to make his case in court. Well, he has had his chance. He has failed. Judges, including those appointed by Mr. Trump, have made clear the election was not stolen. The dodge has run its course.

“I think the democratic process is strong and can certainly survive this discussion,” Mr. Blunt said. That would be true if he and others would stand tall and refute Mr. Trump’s toxic lies. As long as they allow the poison to circulate, they are abetting the weakening of that democratic process.

Some Republicans are true American heros.

Raffensperger told the FOX 5 I-Team the hand ballot recount is mostly matching the computer count and mistakes they have found have not significantly changed the vote total.

Senior I-Team reporter Dale Russell said Raffensperger made the comment after discussing death threats and scathing political attacks he has received from members of his own party.

"What's really troubling about it is when threats actually came into my wife's you know cell phone," said Raffensperger.

These are some of the threats sent to at threat to Secretary of State Brad Raffensperger's wife's private cell phone number and obtained exclusively by FOX 5:

"You better not botch this recount. Your life depends on it."

"Your husband deserves to face a firing squad."

"The Raffenspergers should be put on trial for treason and face execution."

"That is what is really offensive," said Raffensperger.

The personal threats and political attacks have flown fast and furious at Georgia’s Republican Secretary of State. He has said all along the election was fair, free of fraud, and accurate.

"I believe we had a successful election," said Raffesnperger.

But his Republican brothers and sisters disagreed, blaming him for not heeding the call to root out more alleged illegal votes.

From President Trump's tweets, to Senators Loeffler and Perdue calling for his resignation, and losing Republican Senate candidate and Trump's recount director Doug Collins tweeting Raffesnperger was incompetent.

Few Consequences for Attacking American Democracy
9:38 am EST
Quinta Jurecic:
“Donald Trump will not serve a second term. The litigation launched by his campaign and the Republican Party to overturn the election results has no chance of preventing Joe Biden from swearing the oath of office on January 20—as Trump himself seemed to haltingly recognize last week after his administration finally allowed the presidential transition to begin.

“But even though the worst has not come to pass, Trump and his team are doing lasting damage to American democracy as the president struggles to come to grips with the reality of his loss. And yet, these lawyers and officials will likely face no real consequences for their actions—and if they do, those repercussions will not be enough to address the scale of the problem.”

HERE COMES A REAL KNEE SLAPPER:
Something Fishy In Edison County
9:36 am
A witness in Sidney Powell’s new Michigan lawsuit challenging President Trump’s loss in the state says in a declaration he thinks there’s something fishy about election returns in Edison County, Michigan.

Bridge Michigan notes one problem: There is no Edison County in Michigan.

GOP Silence on Trump Recalls [GOP Cowardice During] the McCarthy Era
8:57 am
Ron Brownstein:
“The silence of congressional Republican leaders as President Trump’s unfounded claims of election fraud grow wilder and more venomous increasingly resembles the party’s deference to Sen. Joe McCarthy during the worst excesses of his anti-Communist crusade in the early 1950s.

“In McCarthy’s era, most of the GOP’s leaders found excuses to avoid challenging conspiracy theories that they knew to be implausible, even as evidence of their costs to the nation steadily mounted. For years, despite their private doubts about his charges and methods alike, the top GOP leadership — particularly Senate Republican leader Robert A. Taft, the Mitch McConnell of his day — either passively abetted or actively supported McCarthy’s scattershot claims of treason and Communist infiltration.

“A significant faction of Senate Republicans didn’t join with Democrats to curb McCarthy’s power until the senator immolated himself with his accusations, in highly publicized 1953 and 1954 hearings, that the Army was riddled with Communists during the presidency of fellow Republican Dwight Eisenhower.”

The leftist media is furious again, this time because Donald Trump is refusing to accept the results of the 2020 election. Norms! They scream. We need a peaceful transfer of power, an acceptance of the results, they say. Um, wait. Aren’t these the same people who cheered p-ssy hats and the chants of “not my president?” Those of us on the right didn’t forget about all of that.

For four years, not a few months, the Democrats and their media allies insisted first that Trump’s election was not legitimate and then that he was a Russian asset. It was abject nonsense, a lie. It was a hysterical and long-lasting undermining of our democracy. Now these same clowns, these buffoons, are lecturing us about accepting the results.

Let me put this as plainly and cleanly as possible: “We don’t want to hear it.” For the left to demand now that we must accept the election and get behind the man Americans chose is such a sick and demented joke that it is hard to fathom. These people said Trump was “not my president” so often that their vocal cords have a sense memory of it. They gave Trump absolutely no chance. But now I’m supposed to embrace Joe Biden for the sake of the country? Why don’t you go — I’m sure you can fill in the blank here.

This glorious rediscovery of high-mindedness is as infuriating as it is pointless. Of course, we aren’t going back to the old days after the left destroyed any semblance of decency and fair play. What are we, stupid? This is not how it works anymore, and you know what? Fine. I like the new rules, the ones the left created under Trump. I am perfectly happy to hold anything and everything Biden does as president as suspect and illegitimate. How’s that? Sound familiar?

Biden is the very lovely and nice man who is bringing the drone team back together from the Obama administration to kill kids in the Middle East. He’ll put our soldiers in harm’s way, but he has that bright Irish smile and says all the right things.

All the dudes on CNN and MSNBC have to adjust their pants before they stand up, I get it. But I don’t have to adjust my pants. And I won’t. I will be treating this presidency like Shylock, like a grown-ass man who knows the deal. Here is what he had to say: “The villainy you teach me I will execute, and it shall go hard, but I will better the instruction.”

You guys made these rules. We can play by them. In fact, I can’t wait. I’m gonna drag your little garbage Democratic presidential administration as long and hard as I can. I learned it from watching you, dad. What did you think was going to happen? Did you think a Trump loss would turn us all into The Bulwark, Bill Kristol “conservatives” excited for more foreign wars? No, my friends, no.

Trump announced a new way of thinking about America. In fairness, he didn’t invent it, Ross Perot and Patrick Buchanan were talking about it when I was a teenager a long time ago. But it’s here and it’s not going anywhere. It’s the new Republican Party. And I am so here for it I don’t even know how to express my joy. This is the new fight, and you guys are gonna lose.

I think the left needs to understand where the right is in the boldest terms possible. And, after all, I am the New York correspondent. So let me put it plainly. You want me to accept the legitimacy of a Biden presidency? You want me to be the bigger man? You want me to forget that you said Trump was not your president? You want me to pretend you ever gave the slightest concern about norms and transfers of power and whatever?

I have one thing to say to you: Jerk yourself around.

Dear President Vladimir Putin,

As an expression of my thanks to you for everything you, and your Country have done for me, I want you to be aware of the following action I have taken:

Effective immediately, I have withdrawn the United States from the "Open Skies Surveillance Treaty". As you know, the "Open Skies Surveillance Treaty" allowed the United States to fly reconnaissance missions over Russia, and provide the U.S. with surveillance of Russian Military activity.

This agreement was not a problem while I was President of the United States, because as we both know, if I had been warned of any Russian Military buildup on the border of any other Country, I would have ignored it.

However, we both know that Joe Biden does not love Russia the way that I do. Russia does not hold the leverage over Joe Biden as they do me, and if Biden is warned of a Russian Military buildup, he will react to it. My decision to withdraw the United States from the "Open Skies Surveillance Treaty", will protect you, and Russia from this U.S. surveillance.

After withdrawing the U.S. from the "Open Skies Surveillance Treaty", I then feared that Joe Biden would rejoin the "Open Skies Surveillance Treaty", once taking office. To prevent this, I have taken steps to make this extremely difficult for him to do so, by ordering the destruction of all of the OC-135B Air Force reconnaissance planes which were developed, and equipped for the specific purpose of providing surveillance of Russia.

Now, not only has the United Stated withdrawn from the "Open Skies Surveillance Treaty" they no longer even have the planes required for the surveillance of Russia.

I hope you are satisfied with these actions I have taken. Please send me a list of everything you would like me to do before I leave office.

Sincerely,

Donald J. Trump aka Lame Duck President, Lame Duck Donald, Lame Duck Trump, Lame Donald Duck Trump, Impeached Trump, Impeached Donald Trump, Trump the Lying King, Trump the Tax Cheat Goldenshower Loving Pervert
