Twitter sued by computer repair shop owner who turned in Hunter Biden's laptop to FBI

 Asking for $500 million in damages for defamation!


So what did Twitter do to John Paul Mac Isaac to cause him to sue over defamation? Well when they accused him of hacking Hunter Biden's laptop to garner information, they were actually accusing a private citizen of a federal felony with absolutely zero evidence that it was true?

So it does seem relatively serious when a company as large as Twitter decides to accuse a computer repair shop of illegally hacking into the computers. Might as well accuse of auto mechanic of purposely cutting break lines of the cars people bring in for oil changes.

In the case of the Hunter Biden computer, access to his hard drive was permitted based on what Hunter Biden brought is computer in for and because Hunter Biden would have signed a waiver to allow it. Now whether or not the information within the hard drive should have been used as it was is an ethically murky area, but not a matter of criminal question.  

Now what prompted this accusation from Twitter? Well they had to come up with some "reason" to ban the information on Hunter Biden in order to "stop the spread" of this harmful political story to their personal favored candidate. But as a "public forum" living under the rules of section 230, they are not allowed to edit tweets based on politics or simply because they don't like a story. They can only do it if the story violates one of their policies (which are also limited by section 230).

But the Hunter Biden story did not otherwise qualify to be censored for any of the normal reasons. They did not have any proof that it was untrue (it was true). It was being reported by a reputable media source who has been in business for over 200 years. So they were left in a quandary as to how to stop the spread.  

So they determined that the story could not be tweeted because it was "hacked information" and thus illegally acquired by the source in question. They had no evidence that the information was "illegally" obtained from the repair shop, but they used the pretense to censor the story and prevent anyone from tweeting about it.

Since Twitter later recanted all of this and eventually allowed the story to be tweeted, they have already provided an admission that they were wrong. But yet, they still accused a small business owner of being a Federal felon and have neither retracted or apologized for doing so. I certainly don't believe that Twitter did what they did out of spite for Mr Isaac. But they did it none-the-less and in doing so misused the massive power they wield as arbitrators of possibly the most influential public forum ever in existence. 

More to the point, this exposes exactly what sort of issues that might come up as Twitter continues to try to censor and otherwise control the Section 230 public forum that they created. They are treading the legal and ethical boundaries every time they decide to censor something. Any time they do it could be a violation of the law, first amendment, or common decency. Would have been so much easier for everyone involved if Twitter stuck by the same hands off approach that they had for the first 13-14 years of existence. There is simply no need (and quite frankly no legal means) for them to start censoring, fact-checking, and whatever else they want to start doing. Why they suddenly felt this need becomes the question at issue.

There is not a doctor on the planet that wouldn't tell this person that he had been exposed previously and was already infected by the time the Party took place.

Actually if they repealed section 230... there would be no more Twitter or Facebook for that matter. Those platforms "only" exist because of those protections.

If they "repealed" 230, then Social media would be held responsible for everything stated on their site. Johnny is insulted by Suzie on Facebook, and he could then sue Zuckerberg for his troubles and Zuckerberg (not Suzie) would be responsible.

Mountain, 60, who was hospitalized twice in recent weeks, said he likely contracted the coronavirus at the annual White House Hanukkah party. The event took place amid the worst surge in COVID-19 this country has seen since the pandemic began.

“No one can ever say for sure exactly where they got it, but I’ll say this: Before the party, I was in perfectly good health,” he said. “Three days later, I was in the hospital with COVID, and it was all downhill from there.”

Mountain, who also chairs the Newton Republican City Committee, said he attended the first of two Hanukkah parties hosted on Wednesday, Dec. 9, in the White House’s East Wing. The event was split in half to reduce the size of the gathering, but the list of attendees was still well over 100.

Though everyone was required to wear masks in the line to enter the event, Mountain said, there were no temperature checks or other prevention protocols in place. And once inside, “hardly anyone was wearing masks,” he said. “People were eating, it was a big banquet.”

In order to comply with state testing laws, Mountain took a COVID test after returning to Massachusetts. He received his results that Friday evening: He was positive — and hardly surprised.

“I was deteriorating rapidly anyway,” said Mountain, who added that he’d already started showing symptoms before his test on Friday. The next morning, he was in the emergency room at Brigham and Women’s Hospital, where he spent the day before being discharged. However, his condition worsened yet again the following week, and he returned to the hospital on Dec. 19.

“It’s not fun,” he said.” I came very close — not once but twice — to them hooking me up to a ventilator.”

Mountain was released for the second time that Saturday after approximately eight hours in the hospital, and remains in recovery at his home in Newton with moderate symptoms.

Mountain said that he would never have attended the party had he known someone there was spreading the virus, and said that he wishes he had heeded his family’s advice.

“I was one of those people who thought I would never be a statistic,” he said. “But any large gathering like that where you have people from all over the country, somebody’s bound to have it.”

Now, his wife, son, daughter-in-law, and mother-in-law have also all tested positive for the virus, he said.

“I have to admit I wasn’t the most careful about wearing the face masks,” Mountain said, “but now I’m zealous about it. I have no doubt about their necessity.”

Well Roger - you left out the most important part:

(1) Treatment of publisher or speaker
No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider.


In other words, Facebook and Twitter are not publishers and therefor are not entitled to determine which materials are published other than in the areas that you refer to.

Which are "good faith" attempts to restrict obscene, lewd, lascivious, filthy, excessively violent, harassing, or otherwise objectionable


This is not about protecting people from stories about Hunter Biden. The idea that "otherwise objectionable" might provide a license to simply censor particular stories based on their own ideas WOULD in fact turn them into a publisher (which the law states that they are not).


So you have to look at what a "publisher is" - meaning they get to decide the type and flavor of content. They can choose to be liberal, conservative, comedic, sarcastic, or whatever. But they ARE responsible for everything that is published.

and you can look at what a public forum is - meaning that they do not get to decide the "type of content" and are only allowed to restrict things that are considered obscene, lewd and objectionable in those regards.


When you pick and choose which political stories are allowed or not allowed... then you are a publisher and not an open forum. This is the fact that you will NEVER get through your thick skull.

If congress "really" wanted to allow section 230 public forums to censor or edit content based on political views, then that would be explicitly written into the law.

The law only explicitly allows them to restrict lewd, obscene, violent, harassingly or objectionable (within those same concepts).

This would not (under any circumstances of the law) allow for restriction of certain mainstream political views or for restriction of actual media stories that are not lewd, obscene, harassing, etc... just because the owners of Facebook or Twitter do not like the content.

I don't agree with the President's idea of repealing section 230, because it would put Facebook and Twitter and every other public forum out of business. I think that is a backassward way of looking at it.

What I would prefer is that Facebook and Twitter do what they have done for 99% of the time that they have been in existence. That is to provide the forum that they provide, keep lewd and harassing materials off the forums... and leave the rest of the content alone.

It worked for them for as long as they have been in existence. What is the pressing need for them to decide in 2020 to start policing things over political reasons. It has created nothing but problems.

You have to take the law within the contents of how it was written. Objectionable would be taken (legally) within the contents of the other portions of that same sentence. Lewd, obscene, excessively violent, harassing, etc. It doesn't exist on it's own in any other definition other than the context of that sentence (which is 100% about things that are generally offensive to most everyone regardless of political affiliation or beliefs).

If you decide to strip twitter of everything that anyone might find unpleasant than twitter does not exist. Because liberal will find conservative speech unpleasant and conservatives will find liberal speech unpleasant.

But if Twitter decides for themselves to choose liberal over conservative or conservative over liberal... then they are making "editorial decisions" and then becomes a publisher responsible for what is printed.

You will also notice that there is nothing in section 230 that provides the ability for the restrict content on the basis of "fact checking".

Now quite obviously it would be lovely if everyone in the world told the truth 100% of the time and everyone agrees with what a "fact" is.

But when Twitter decides that a true story about Hunter Biden should be "restricted" for whatever reasons, while allowing conspiracy theory tweets about the President and Russian collusion (which was entirely false).

How is that about fact checking?
