FBI infiltrators comprised, at the very least, 26 percent of the plotters. That is, at least five FBI operatives have been disclosed, against just 14 suspects indicted. A look at the annotated indictment reveals that at every level of the plot, FBI operatives played the most important leadership roles:
- The plot’s “explosives expert,” who the plotters were accused of planning to buy bombs from, turned out to be an FBI agent.
- The head of transportation for the militia outfit turned out to be an undercover FBI agent.
- The head of security for the militia outfit turned out to be an undercover FBI informant.
- At least two undercover FBI informants were active participants in the initial June 6, 2020 meeting in which the plot to storm Capitol buildings was allegedly hatched — meaning at least three FBI informants infiltrated before the conspiracy even started.
Now this information has to do with an alleged plot to kidnap Michigan Governor Gretchen Whitmer. A plot that the FBI claims to have foiled. Of course they foiled it, when they appear to have actually plotted it as well. If almost all of the instigation and leadership came from undercover agents, I would hope that the FBI could stop it.
In fact, when the FBI came to stop the plot and started to arrest people. 60% of those alleged kidnappers at the scene were actually undercover FBI. Nice.
According to more of the documentation available, pretty much all of the funding involved came from the FBI agents. Moreover it was an FBI agent who reached out to other FBI agents as to how to get tactical equipment, weapons, and explosives. They were even involved in initial meetings, likely as the people setting them up. At this point there are at least five known FBI undercover agents involved, as well as lord knows how many "informants" (people under the wing of the FBI). They had infiltrated and were involved prior to even the first meeting.

— The Supreme Court has dismissed a challenge to the Obama era health care law, preserving insurance coverage for millions of Americans.
The justices, by a 7-2 vote, left the entire law intact Thursday in ruling that Texas, other Republican-led states and two individuals had no right to bring their lawsuit in federal court.
The law’s major provisions include protections for people with pre-existing health conditions, a range of no-cost preventive services and the expansion of the Medicaid program that insures lower-income people, including those who work in jobs that don’t pay much or provide health insurance.
Also left in place is the law’s now-toothless requirement that people have health insurance or pay a penalty. Congress rendered that provision irrelevant in 2017 when it reduced the penalty to zero.
The elimination of the penalty had become the hook that Texas and other Republican-led states, as well as the Trump administration, used to attack the entire law. They argued that without the mandate, a pillar of the law when it was passed in 2010, the rest of the law should fall, too.
And with a more conservative Supreme Court that includes three Trump appointees, opponents of “Obamacare” hoped a majority of the justices would finally kill off the law they have been fighting against for more than a decade.
But the third major attack on the law at the Supreme Court ended the way the first two did, with a majority of the court rebuffing efforts to gut the law or get rid of it altogether.
Trump’s three appointees to the Supreme Court — Justices Amy Coney Barrett, Neil Gorsuch and Brett Kavanaugh — split their votes. Kavanaugh and Barrett joined the majority. Gorsuch was in dissent, signing on to an opinion from Justice Samuel Alito.

The Fox News opinion host whose legal defense has been that viewers shouldn’t believe what he says is literally true has now tried to suggest that “unindicted co-conspirators” cited in connection with the Jan. 6th siege on the U.S. Capitol Complex may have been undercover government actors. Tucker Carlson insinuated that the government was to blame for what happened at the Capitol by citing to a website which failed to cite or analyze the law or common legal practices while claiming a government conspiracy surrounded what occurred on Jan. 6th.
The Broadcast
In a Tuesday evening monologue, Carlson ranted about “Person 2” — a man alleged to have “stormed the barricades” around the Capitol and stayed in a hotel room with indicted Oath Keepers member Thomas Caldwell — and “Person 3,” another unidentified and uncharged co-conspirator.
“In potentially every single case, they were FBI operatives,” Carlson suggested. “Really? In the Capitol on Jan. 6th!”
“They were almost certainly working for the FBI,” Carlson also said of these “persons.”
He then called the unnamed individuals the “organizers” of what took place.
“So, FBI operatives were organizing the attack on the capitol on January 6th, according to government documents,” he exclaimed. “So, it turns out this white supremacist insurrection was — again, by the government’s own admission in these documents — organized at least in part by government agents!”
Embattled congressman Matt Gaetz (R-Fla.) and controversial congresswoman Marjorie Taylor Greene (R-Ga.) quickly amplified Carlson’s speculation on Twitter, using it to call for an investigation.
Much of the Carlson monologue was sourced to Revolver News, a website Forbes has described as a “right-wing” aggregator of content. Last summer, the site advocated the shooting of racial justice protesters. It has been heavily promoted by Donald Trump and members of his administration.
The underlying Revolver story claimed that a “curious lack of indictments” against unindicted co-conspirators referenced in various capitol siege cases — including individuals known as “Person 2, Person 3, Person 10, Person 14, Person 15, Person 16, Person 19 and Person 20, along with many co-conspirators” — raised troubling “red flags.” The Revolver story also suggested, as did Carlson, that the unnamed and unindicted individuals were undercover government agents.
The Revolver article used the word “entrapment” a sum total of four times to describe the alleged actions of these alleged government agents. That’s a legally operative word we’ll discuss further in a moment.
A Revolver representative, Darren Beattie, appeared on Carlson’s broadcast to agree that the “remarkable” report “certainly suggests” the “possibility” that the FBI “organized the riots.” Beattie claimed that the piece is “the most important and the darkest investigative piece” many people have seen “in years.” Beattie said people deserved to know the truth about what occurred on Jan. 6th for the sake of Ashli Babbitt and others. Babbitt was shot and killed by a law enforcement officer as she attempted to enter the Speaker’s Lobby during the siege.
Beattie claimed the “key that unlocks the truth to 1/6” is the question of whether the key militia groups were infiltrated and led by the FBI and other government agencies — in other words, spurred to do what they did by the government and then branded as domestic terrorists.
As an aside, the New York Times reported last November that Beattie was fired from the Trump White House as a speechwriter in 2018 for attending “a gathering with white nationalists.” He later was placed on a commission which aims to preserve sites related to the Holocaust — a move which was opposed by the Anti-Defamation League.
Both Carlson and Beattie admitted that additional information was necessary to fully answer the question. Gaetz agreed by midday on Wednesday and demanded to know whether FBI agents were “active instigators.”

The FBI was not framing Trump supporters for treason. They were undercover policemen who put their lives at risk the minute they walk outside of their homes.
It is not common for federal court documents to refer to undercover agents or criminal informants merely as “persons.” Under common DOJ parlance, Informants are referred to as “Confidential Human Sources” (“CHS”), and agents are referred to as “Undercover Employees” (“UCE“), as the Revolver story itself points out.
Additionally, the Justice Department’s manual for U.S. Attorneys says “prosecutors generally should not identify unindicted co-conspirators in conspiracy indictments.” The manual, citing case law, suggests only “generic reference” to such individuals.
The 1975 case upon which the Justice Manual’s prohibition is based warns of “harm to the citizen who is accused but not indicted.” It suggests “private injury” may “stigmatiz[e] private citizens as criminals while not naming them as defendants or affording [them] access to any forum for vindication.”
“[W]e know of no reason why, if the indictment wishes to center upon a specific person but not name him as defendant, he cannot be described as ‘John Doe,'” the court said. “An unindicted conspirator anonymously designated as an ‘other person’ or as ‘John Doe’ may be unmasked in a bill of particulars or at trial.”
The procedure followed generally by the Capitol siege cases follows these patterns and practices.

While we await the identities of the various “persons” referenced by Carlson and the Revolver, it’s important to acknowledge that the underlying law of entrapment does not suggest the type of legal bombshell contemplated by Beattie or Carlson.
And that’s important. Even if Beattie and Carlson are completely correct — and that’s unlikely — it likely won’t matter much legally.
The Revolver story started to insinuate an entrapment defense for those charged:
If it turns out that an extraordinary percentage of the members of these groups involved in planning and executing the Capitol Siege were federal informants or undercover operatives, the implications would be nothing short of staggering. This would be far worse than the already bad situation of the government knowing about the possibility of violence and doing nothing. Instead, this would imply that elements of the federal government were active instigators in the most egregious and spectacular aspects of 1/6, amounting to a monumental entrapment scheme used as a pretext to imprison otherwise harmless protestors at the Capitol — and in a much larger sense used to frame the entire MAGA movement as potential domestic terrorists.
Indeed, if the federal government knew of a potential for violence in or around the Capitol on 1/6 and failed to call for heightened security, the agencies responsible may in fact be legally liable for the damages incurred during that day.
The Revolver story went on to attempt to compare the acknowledged use of undercover agents in cases involving a plot to kidnap Democratic Michigan Gov. Gretchen Whitmer and the cases involving the Jan. 6th siege at the U.S. Capitol Complex.
“The possibility of an FBI entrapment-type operation is especially disturbing in light of the striking parallels between the Michigan Plot and the so-called Capitol Siege of 1/6,” the Revolver story said.
The problem is that the story logically leaps to — or suggests — the legal conclusion that the use of undercover informants is a bad thing. The Revolver cites no laws, so the piece asks its readers to agree that “a potentially extraordinary scandal” is afoot without any authoritative argument as to whether the alleged underlying conduct — even if it is true — is illegal.

Yeah, the story suggests that it is possible that FBI might have infiltrated people in regards to Jan 6th, but doesn't actually state that as any matter of fact.
Rather it provides the factual account of how they "did" infiltrate and plan an entirely different attack and then arrest those who followed along.
The main difference, in my mind, is that there is no real evidence that the Jan 6th Capital riot was any sort of planned event. There certainly did not appear to be any real coordination or any real "plan" as to what they might do if they had gotten inside.
In the plot to kidnap the Michigan Governor, they were carrying weapons, explosives and were coming with a distinct plan (mainly hatched by the FBI). There was no such weapons, explosives, or distinct plan associated with Jan 6th.
Nobody is suggesting that anyone from Jan 6th was part of any entrapment. Just that when the FBI sends in agents to infiltrate an organization, then has those same FBI agents plan an attack including getting explosives and weapons (from other FBI agents) - the idea that arresting the people following was somehow a "thwarting" of a white supremacist attack on the Governor is a little far-fetched. They only aborted their own mission and then arrested those who came along.
That didn't happen on Jan 6th (as far as we know). But it did happen in the kidnapping plot.

Generally speaking, entrapment defenses focus on what the U.S. Supreme Court and other courts have called “predisposition” — that is, whether the defendant was “ready and willing without persuasion” to commit a crime and was “awaiting any propitious opportunity to commit the offense.” Though there is some disagreement in the case law about the precise parameters of law of entrapment, the legal test employed generally measures a defendant’s propensities and inclinations regardless of an undercover agent’s involvement. If a defendant is already on track to commit a crime and an undercover agent merely greases the rails and helps make the crime happen, entrapment does not occur, and the defendant is usually caught red-handed by a government agent witness who is more than willing to testify about the particulars. The legal theory at play here is that the defendant would have simply engaged the assistance of someone other than the undercover government agent and committed the crime anyway.
But this is classic strawman.
By drawing invalid parallels like the attempt to kidnap a governor to the Insurrection is classic straw man parallel.

WASHINGTON—The Supreme Court on Thursday rejected a challenge to the Affordable Care Act, the third time it has preserved the 2010 healthcare law.
Texas and other Republican-leaning states, backed by the Trump administration, sought to strike down the law on technical arguments after Congress reduced to zero the tax penalty for failing to carry health insurance. Thursday’s 7-2 decision, written by Justice Stephen Breyer, found that none of the plaintiffs suffered any injury from zeroing out the penalty and thus they lacked legal standing to bring the lawsuit at all.

Did Joe Biden finally exorcise the ghost of Helsinki? “I did what I came to do,” he declared on Wednesday, at the end of an afternoon summit with Russian President Vladimir Putin. Speaking to reporters in brilliant sunshine outside an eighteenth-century villa in Geneva, where the two had concluded several hours of discussion, Biden insisted that he left the meeting with a “genuine prospect” for improved relations with Russia. He also announced further talks, on nuclear arms and cyberwarfare, that may or may not lead to new agreements. Just as newsy as the meeting’s limited concrete outcomes was the image of an American President standing up to Putin in all the ways that Donald Trump—the last American President to meet Putin—never did.
Back in 2018, on a lovely summer day in Helsinki, in a press conference that will long be remembered as a most bizarre sellout of American interests, Trump had alternately praised his Russian counterpart and cowered to him. He said that he accepted Putin’s word over that of his own intelligence agencies about Russia’s election interference in 2016. He blamed the United States for bad relations with Russia. Putin stood smirking alongside him as he said all of these things.
Biden’s summit was carefully orchestrated to send a very different message. Most significantly, given Helsinki, there would be no joint press conference, no side-by-side appearance at which Putin could upstage Biden or provoke or taunt him. Biden would not meet alone with Putin, without a note-taker, as Trump had insisted on doing—who knows why—in 2018. And there would be no chatty lunch or informal socializing, as is often scheduled during such superpower summits.
The timing of the meeting in Geneva—after a round of meetings with Western counterparts in the United Kingdom and Brussels—also underscored Biden’s I’m-not-Trump approach. The President only met with Putin after days of mutual lovefests with Western allies; Trump ended up in Helsinki after a NATO summit so contentious that he had forced the group into an emergency session and, at one point, even threatened to blow up the alliance. Biden, in contrast, arrived in Geneva representing a more publicly united front. Unlike Trump. And unlike Putin, for that matter, who has . . . Belarus? China, sort of? At a NATO summit on Monday, the alliance released a lengthy communiqué that mentioned Russia sixty-two times, characterizing the country as a “threat” and cataloguing a variety of grievances and concerns about its actions in recent years.
Still, the many days of buildup also risked the summit seeming like a letdown. No matter how low Biden’s advisers sought to set expectations, Putin has engaged in a series of provocations in recent months—from sending more than a hundred thousand troops to the border with Ukraine to jailing Russia’s main opposition leader to unleashing crippling cyberattacks inside the United States—that progress of any kind seemed unlikely. Biden could still come out of it with the world and much of Washington wondering just why had he bothered with the summit in the first place.
As the capstone for Biden’s first overseas trip as President, the Putin meeting began with a photo op in a spectacular book-lined study in the sprawling Villa La Grange, on Lake Geneva. The smallest details were covered as breathless breaking news: What does it mean that Biden called the Russian leader a “worthy adversary” before the meeting? Why did Putin call Biden a “career man,” given that his own two decades in power make him Russia’s longest-serving leader since Josef Stalin? During a long wait for the two leaders to come out and actually say something, reporters pored over the staged photos in search of meaning; one sharp-eyed Mexican journalist even noted that the two delegations each had their own different brand of bottled water.

But you can also tell a plausible story about why inflation won’t last. This is the scenario that most officials at the Fed and in the Biden administration consider to be more likely.
One reason to be skeptical about dire inflation warnings is that economists have repeatedly overestimated the risks of inflation in the 21st century. And several features of the modern American economy seem to restrain inflation. Global competition is one, Powell has argued. Another is American workers’ relative lack of bargaining power, which means that companies can often wait out temporary price spikes without increasing wages.
Fed officials believe that these larger forces will prove more powerful than the short-term disruptions from the economy’s post-pandemic reopening. (Neil has written a helpful explainer on this subject.)
Already, there is some evidence to support the Fed’s sanguine view. Some companies have responded to higher prices, and to the opportunity to make higher profits, by increasing output. To take one example, lumber prices, after rising sharply, are now falling. “As the economy is opening back up again, prices are now moving back toward normal levels in leisure, hospitality, airfare and the like,” Janet Yellen, the Treasury secretary, said in a Senate hearing yesterday.
The coming end to federal stimulus will also serve to reduce demand. The spending from the $1.9 trillion bill that President Biden signed in March will mostly expire by early summer. Once that happens, the decline in government spending will act as a drag on economic growth and help hold down inflation.

Donald Trump may no longer be president, using his platform to spread racist rhetoric and lies about marginalized communities, but Republicans are still capitalizing on the culture wars that came out of his administration. The GOP’s latest target in their fight to preserve the white supremacist institutions on which the United States was founded? Critical race theory.
Across the country, Republican lawmakers, along with conservative activists and media, are hard at work demanding that critical race theory not be taught in schools. What is critical race theory, exactly? Well, Republicans certainly don’t seem to know, even as they profess to be terrified of it, and deploy it as a convenient catch-all phrase to scare conservatives who don’t want their kids learning about racism in the classroom.
Beyond being a Republican talking point, critical race theory as a framework for education was developed in the late 1970s and early 1980s by legal scholars Derrick Bell, Kimberlé Crenshaw, Patricia Williams, and Richard Delgado, among many others. The framework is used to analyze the relationship between racism and the legal system, and the institutions that uphold it. As Crenshaw told CNN last year, “Critical race theory is a practice. It’s an approach to grappling with a history of white supremacy that rejects the belief that what’s in the past is in the past, and that the laws and systems that grow from that past are detached from it.”
The sociologist and author Eve Ewing also shared her own brief explainer on the subject via Instagram last month. Critical race theory is “not a specific topic or area of study, but it’s a way of looking at anything,” said Ewing. “It’s not the same as just studying Black history, which is a specific area of focus. You could use critical race theory to study Black history, you can use critical race theory to study lots of other things,” she added.

The growing movement to oppose the concept claims that critical race theory “teaches kids to hate America,” that all white people are racist, and that it advocates discrimination against white people. Some say the framework is a Marxist concept, another term conservatives have used in recent years to treat Black liberation and Leftist activism as a Communist boogeyman that they say will ruin America.
Now, Republican lawmakers are using the moral panic over critical race theory to push legislation that seeks to ban educators from teaching students how to think critically about American history and racism.
Some of the legislation came in response to an announcement from President Joe Biden’s administration of a grant program for history and civics curriculum to prioritize teaching concepts like systemic racism and discriminatory policies in the United States. The Biden administration cited the 1619 Project, published by The New York Times as inspiration for the program. Last year, the Trump administration created the 1776 commission in response to the 1619 Project in an effort to push a whitewashed version of U.S. history in K-12 classrooms that would focus on what Trump referred to as “patriotic education.”
On Capitol Hill, at least 39 Republican senators said history education that focuses on systemic racism is “activist indoctrination,” according to The New York Times. Lawmakers in nearly half the country have used this moment as an opportunity to introduce legislation that seeks to ban schools from teaching that racism is endemic to this country’s institutions.

We reached out to 46 lawmakers in 23 states who have either introduced or supported such legislation to ask them: What is critical race theory? How do you define it in your legislation, and what would educators be banned from teaching? Most didn’t respond to requests for comment, but we will update this story with their comments if they figure out what it is they’re trying to ban.
As for those who did write back, Idaho State Rep. Wendy Horman told Refinery29 that HB 377, which passed in the Idaho Senate in April, neither defines critical race theory, nor prohibits it from being taught in schools. (The concept did, however, come up during a committee meeting regarding the bill.)
“There are Democrats and Blacks who also have concerns about CRT, so while the political response is mainly being led by Republicans it is not exclusively true that all Blacks or Democrats support CRT,” Horman told Refinery29 via email. “Although they did not ultimately vote yes, members of both those groups were involved in the discussion and drafting of H377 in Idaho. I see this less as an ideological issue and more as an issue of the humanity that we all share.” Okay.
A representative for Florida Gov. Ron DeSantis, who has been particularly vocal in the “culture wars” regarding critical race theory, defined the concept as “an ideology rooted in identity-based Marxism.” They added, “No one should be stereotyped based on the color of their skin. It’s appalling that children are being divided into ‘oppressor’ and ‘oppressed’ categories

But when asked about the concept by AL.com columnist Kyle Whitmire, Pringle struggled to clearly define it.
As part of his definition, he said the practice teaches students "certain children are inherently bad because of the color of their skin."
When pressed to name a specific person claiming to teach that, Pringle responded: "Yeah, uh, well - I can assure you - I'll have to read a lot more," he said.
"These people, when they were doing the training programs - and the government - if you didn't buy into what they taught you a hundred percent, they sent you away to a reeducation camp," Pringle added without evidence.

Revolver’s major investigation into the January 6 Capitol incident has sparked a gargantuan response from Congress and the press.
First, the backstory.
In a report published late Sunday night, Revolver explored the federal indictments against members of the Proud Boys and Oathkeepers, and found that the leading planners and provocateurs of the 1/6 incursion weren’t the individuals who have been publicly charged with crimes, but the unindicted persons who were present at the Capitol alongside them.
Revolver’s investigation raised disturbing possibilities. Would 1/6 have happened without substantial agitation by federal law enforcement to make it happen? Did shadowy forces recognize the January 6 rally from the beginning as an opportunity to harm the Trump movement to take back America? Was the entire militia/white nationalist “threat” substantially a creation of federal law enforcement for the purpose of defaming and discrediting right-wing populism?
Revolver has raised the questions. But it will take work by allies within the government to reveal the full truth. And thankfully, several lawmakers are already stepping up.
Late Tuesday, in the wake of Revolver’s investigation, Congressman Matt Gaetz of Florida sent a letter to FBI Director Christopher Wray demanding to know how many undercover federal agents and informants were present at the Capitol, what roles they played, and how many of them had infiltrated the Proud Boys, Oathkeepers, and Three Percenters:

And when that’s all done against the backdrop of large numbers of Republicans having been convinced wrongly that there was something fishy about the last election, we’ve got a problem,” reported Breitbart.
He continued, “I thought that there were enough guardrails institutionally that even after Trump was elected that you would have the so-called Republican establishment who would say okay, you know, it’s a problem if the White House isn’t — doesn’t seem to be concerned about Russian meddling, or it’s a problem if we have a president who is saying neo-Nazis are marching in Charlottesville, there are good people on both sides.”

In 1982, the economist Mancur Olson set out to explain a paradox. West Germany and Japan endured widespread devastation during World War II, yet in the years after the war both countries experienced miraculous economic growth. Britain, on the other hand, emerged victorious from the war, with its institutions more intact, and yet it immediately entered a period of slow economic growth that left it lagging other European democracies. What happened?
In his book “The Rise and Decline of Nations,” Olson concluded that Germany and Japan enjoyed explosive growth precisely because their old arrangements had been disrupted. The devastation itself, and the forces of American occupation and reconstruction, dislodged the interest groups that had held back innovation. The old patterns that stifled experimentation were swept away. The disruption opened space for something new.
Something similar may be happening today. Covid-19 has disrupted daily American life in a way few emergencies have before. But it has also shaken things up and cleared the way for an economic boom and social revival.
Millions of Americans endured grievous loss and anxiety during this pandemic, but many also used this time as a preparation period, so they could burst out of the gate when things opened up. After decades of slowing entrepreneurial dynamism, 4.4 million new businesses were started in 2020, by far a modern record. A report from Udemy, an online course provider, says that 38 percent of workers took some additional training during 2020, up from only 14 percent in 2019.

After decades in which consumption took preference over savings, Americans socked away trillions of dollars in 2020, reducing their debt burdens to lows not seen since 1980 and putting themselves in a position to spend lavishly as things open up.
The biggest shifts, though, may be mental. People have been reminded that life is short. For over a year, many experienced daily routines that were slower paced, more rooted, more domestic. Millions of Americans seem ready to change their lives to be more in touch with their values.
The economy has already taken off. Global economic growth is expected to be north of 6 percent this year, and strong growth is expected to last at least through 2022. In late April, Tom Gimbel, who runs the recruiting and staffing firm LaSalle Network, told The Times: “It’s the best job market I’ve seen in 25 years. We have 50 percent more openings now than we did pre-Covid.” Investors are pouring money into new ventures. During the first quarter of this year U.S. start-ups raised $69 billion, 41 percent more than the previous record, set in 2018.
Already, this era of new creation seems to be rebalancing society in at least three ways:
First, power has begun shifting from employers to workers. In March, U.S. manufacturing, for example, expanded at the fastest pace in nearly four decades. Companies are desperate for new workers. Between April 2020 and March 2021, the number of unemployed people per opening plummeted to 1.2 from 5.

Workers are in the driver’s seat, for now, and they know it. The “quit rate” — the number of workers who quit their jobs because they are confident they can get a better one — is at the highest in two decades. Employers are raising wages and benefits to try to lure workers back.
Second, there seems to be a rebalancing between cities and suburbs. Covid-19 accelerated trends that had been underway for a few years, with people moving out of big cities like New York and San Francisco to suburbs, and to rural places like Idaho and the Hudson Valley in New York. Many are moving to get work or because of economic distress, but others say they moved so they could have more space, lead slower-paced lives, be closer to family or interact more with their neighbors.
Finally, there seems to be a rebalancing between work and domestic life. Stanford economist Nicholas Bloom expects that even when the pandemic is over, the number of working days spent at home will increase to 20 percent from 5 percent in the prepandemic era.
While this has increased pressures on many women, millions of Americans who could work remotely found that they liked being home, dining every night with their kids, not hassling with the commute. We are apparently becoming a less work-obsessed and a more domestic society.

In 1910 the educator Henry Van Dyke wrote, “The Spirit of America is best known in Europe by one of its qualities — energy.” That energy seemed to be fading away in recent years, as Americans came to move less and start new businesses less frequently. But the challenge of Covid-19 has summoned forth great dynamism, movement and innovation. Labor productivity rates have surged upward recently.
Americans are searching for ways to make more money while living more connected lives. Joel Kotkin, a professor of urban studies at Chapman University, points out that as the U.S. population disperses, economic and cultural gaps between coastal cities and inland communities will most likely shrink. And, he says, as more and more immigrants settle in rural areas and small towns, their presence might reduce nativism and increase economic competitiveness.
People are shifting their personal lives to address common problems — loneliness and loss of community. Nobody knows where this national journey of discovery will take us, but the voyage has begun.
No matter the season, customers of the Electric Reliability Council of Texas are learning that they may be better off relying on themselves.
Texans have spent the week keeping cool by fanning themselves and finding shade after the power grid's operator, commonly known as ERCOT, asked that they conserve energy as temperatures rise and several power plants fail.
ERCOT officials haven't pinned down the cause of the mechanical issues that led to the breakdowns just four months after a massive power outage left millions of people in the state without heat or electricity.
But some energy experts warn that the recent failures unmask the vulnerability of the state's grid and that they may portend additional shutdowns should temperatures continue to climb this summer.
"It's not a total surprise that hot weather would strain the grid, only it usually happens in August. That's what we expect and plan for," said Michael Webber, a professor of energy resources at the University of Texas at Austin.
Joshua Rhodes, a research associate at the university who studies the state's electrical grid, expressed similar concerns about outages so early in the season before the hottest days of summer.
"The number of power plants that were online for outages was a bit concerning, given where we are and the temperature," he told NBC Dallas-Fort Worth. ERCOT officials this week said the number of plants offline for maintenance issues is at least three times the usual number for this time of year, the station reported.
ERCOT, which oversees 90 percent of Texas' energy production, asked residents Monday to limit their electrical usage through Friday because of an energy emergency, with soaring temperatures and a series of mechanical problems at power plants.
Recently, ERCOT said that the chance of summer power outages was less than 1 percent and that rolling blackouts would occur only in extreme circumstances. However, the nonprofit group avoided blackouts Monday only by using reserve power and asking customers to turn up their thermostats, turn off lights and avoid using some appliances, including ovens and washing machines.
In fact, Monday's power crunch included worst-case scenarios such as lower-than-expected wind power, concerns that solar power would drop off at sunset and a larger-than-expected number of breakdowns at traditional power plants.
Webber blamed the shutdowns partly on climate change, in addition to power plants' hitting capacity limits set decades ago.
"We've planned for the weather of the past instead of the weather for the future," he said. "We're getting more heat often and in different seasons than we expect. We're also getting cold more often and with lower temperatures than we expect."

Clyde — who recently went viral for likening Jan. 6 to a “normal tourist visit” — declined to shake hands, claiming not to know Fanone’s identity. Fanone then introduced himself as a “police officer” who “fought to defend the Capitol,” and described his injuries. Whereupon this happened:
“His response was nothing,” Fanone said. “He turned away from me, pulled out his cellphone and started thumbing through the apps.”
Fanone said Clyde turned on the camera app but did not point the phone in his direction. Fanone said he believes Clyde was trying to record audio of the encounter.

The Supreme Court’s Day of Reckoning is Coming

The election of 2020 is going to lay bare the dereliction of the Supreme Court for all to see. The COVD-19 pandemic gave numerous state election officials an excuse to implement far-reaching changes to our election processes. Those changes obviously made our systems vulnerable to fraud. States implemented massive mail-in balloting at the same time they relaxed ballot security and voter identification. They even extended the voting periods -- to give the criminals more time to commit their fraud.
All these changes were unconstitutional. The Constitution clearly gives the various state legislatures the authority to define how their elections will be conducted -- not state election officials. Election officials are only empowered to conduct elections within the rules set forth by their respective legislatures -- except, apparently, during a pandemic. There must be a pandemic emanation hidden in a penumbra of the Constitution we didn’t know about. Alarmed that the changes would invite fraud, various organizations filed lawsuits to stop the changes.
The Supreme Court declined to get involved. It ruled that the plaintiffs lacked standing because nobody had been harmed -- yet. Since the election hadn’t happened, nobody was damaged, and there was no case to be heard. They were thinking like a civil court, not the defenders of the Constitution they are sworn to be. It was a cowardly way to stay out of the political controversy. Unfortunately, it also missed an opportunity to defend the Constitution, which was clearly under attack.
After all the ad-hoc changes had been allowed to stand, the election of 2020 saw an unprecedented number of irregularities -- too many to ignore. Election observers were banned from observing the election. Counting stopped in the middle of the night and then restarted after boxes of ballots were mysteriously found. There are reports of ballots being driven across state lines -- by the truckload. There were even precincts that counted more ballots than there were registered voters! A number of states filed lawsuits against the states in which these irregularities occurred.
Even though the Supreme Court is supposed to be the arbiter of cases between states, it again refused to get involved. They ruled that Texas couldn’t sue Pennsylvania because Texans had their votes accurately counted and therefore were not harmed by Pennsylvania. Apparently having the wrong president crammed down the throats of Texans is not considered “harm.” Given the flood of illegal aliens President Asterisk has invited -- and the crime that has accompanied them -- would the justices consider Texas “harmed” now?

"This seems like a massive chain of custody problem," the contractor Carter Jones warned in the memo delivered by his firm Seven Hill Strategies to Raffensperger's office shortly after the election.

“An overriding question going into the session that began last October was whether Roberts would still wield significant control, after former President Donald Trump appointed Barrett to succeed the late liberal Justice Ruth Bader Ginsburg and created a 6-3 conservative-liberal bench.

New Video Depicts Capitol Police Using Stun Grenades on Crowd
“The police started shooting at people,” Kelly told me. “There were kids in the crowd.”
This appears to contradict widespread reports and some testimony that claimed police did not use these crowd control devices on January 6.
Kelly was arrested on January 14 and charged with two misdemeanors. He was transported on March 8 to the D.C. jail holding January 6 detainees, where he remains awaiting trial.

Obamacare decision could be watershed moment

'Significant victory'
After the Affordable Care Act passed in 2010, a 27-year-old man stopped me on the street in Chicago and doffed his baseball cap to reveal his hairless head.
"I didn't feel well for a while but didn't have insurance, so I didn't go to the doctor," he told me. "I got coverage through Obamacare and finally went. Turns out, I had non-Hodgkin's Lymphoma, but they caught it in time. I feel like that law saved my life."
Having grappled myself with an unnavigable health care insurance system as the young father of a child with a chronic illness, I have been overcome thinking about this young man and others who have escaped my nightmare as a result of the ACA.
So, on Thursday, I breathed a sigh of relief when the US Supreme Court dismissed a lawsuit filed by Republican-led states and backed by the former Trump administration asking the court to invalidate the ACA. Even on procedural grounds, the 7-2 majority included two Trump appointees to the high court, Justices Brett Kavanaugh and Amy Coney Barrett, which made it all the more impactful.
After all, destroying the law became an obsession for former President Donald Trump and the right -- principally, I suspect, because "Obamacare," as the ACA became known, was considered a signature accomplishment of his predecessor and my old boss, former President Barack Obama.
From the beginning, opponents of the ACA peddled false narratives about "death panels" and socialized medicine to try and stop it. Trump branded it a "total disaster," pressuring Congress to dismantle it without offering any plausible substitute.
Yet the law not only has survived serial court challenges and a relentless disinformation campaign, but a full legislative assault from Trump and the Republicans in Congress and numerous administrative decisions aimed at weakening it.
As Obama predicted when it passed, the ACA has become more popular over time, despite the relentless hammering of Trump and right-wing media.
Why? Because it has made Americans more secure.
Today, more than 20 million Americans who would not have had coverage now are insured thanks to the ACA.
More than that, all Americans with a pre-existing condition -- like my daughter Lauren, who suffers from epilepsy -- no longer can be denied coverage by insurance companies.
All Americans under 26 are eligible to be covered by their parent's insurance.
Americans who are seriously ill and require extensive treatments no longer face insurance coverage caps.
Women and older Americans no longer suffer the grotesque cost disparities that existed before the ACA.
Under Obamacare, treatment for mental illness and substance abuse must be covered.
And the list of its insurance reforms goes on.
To be sure, the ACA is not perfect and was damaged by four years of willful subversion by Trump, whose administration's actions and inaction led to higher deductibles and out-of-pocket costs for policies sold in ACA markets.
And millions of Americans live in 12 states that have yet to, or have refused to, expand Medicaid under the ACA, depriving their eligible constituents of coverage.
But I've also met countless Americans, like the young man in Chicago, in the years since the ACA passed who have approached me with tears of their own, sharing stories about what it has meant to them and their families.
A woman and her husband chased me down in a parking lot after a speech I made to, of all things, an insurance industry convention out West. She had coverage but also a serious cancer, from which she, too, was recovering.
"The ACA came just in time. We would have hit our lifetime cap for coverage," she told me, her husband beaming at her side. "We just wanted to say thanks."
A young father in Peoria, about the same age I was when Lauren began having seizures, told me his 5-year-old son, who was battling a complex medical condition, had coverage due to the ACA. "You can't imagine our relief," he told me.
For the life of me, I don't understand why anyone would want to take that security and peace of mind away from these Americans or any others.
With majority support in the country for the ACA, and a majority of this conservative Supreme Court handing Obamacare opponents yet another defeat, perhaps we will look back at Thursday's ruling as a watershed moment in this decade-long battle.
It's a lot to hope for in these fractious times, but maybe, just maybe, the politicians who would drag us back will finally drop their swords and acknowledge that the Affordable Care Act is here to stay.
