Fridays can be full of surprises sometimes, and we got one today regarding illegal immigration. A federal judge in Houston ruled that DACA, the long-challenged and debated amnesty program for illegal immigrants brought to the US as children, is illegal. That was part of a lawsuit brought by multiple states noting the unconstitutional nature of the program. You may recall that the Supreme Court essentially punted on the issue in the summer of 2020 because Chief Justice John Roberts is a coward who decided to focus on how the program was ended instead of whether its original creation (under Obama) was legal or not.
DACA’s illegality has been obvious since the beginning. Barack Obama himself said over and over via public appearances that he did not have the power to do what he did. That was part of his pressure campaign pointed at Congress in an attempt to force through an amnesty bill. When that didn’t materialize, he acted on his own with authority he didn’t have. On the merits, the idea that protective status via “deferred action” can be bestowed upon a certain group of illegal immigrants, thereby bypassing the delegated authority of the legislature, never held any real legal weight. Yet, as often happens with emotionally charged issues, courts, including the Supreme Court, have tap-danced around the issue instead of saying what everyone knows – that DACA is illegal.
Now, we finally have a judge who has put on record that the program is just that. There are also practical ramifications to this, such as DACA no longer being a magnet (at least until some higher court gets involved) for migrants looking to cross the border illegally. One of the most tragic aspects of the “compassion” shown by illegal immigration advocates, including Joe Biden, is that it encourages dangerous, deadly behavior that ultimately enriches the drug cartels.
So this is an important decision for two pretty big reasons. First is that it is in place until another court decides that this judge is wrong. That puts the ball in the court of DACA advocates (and likely the Biden Administration) to get involved and attempt to have this overturned. Secondly, the fact that there is now a ruling out there that suggests the law is unconstitutional (and everyone knows it is) puts pressure on Roberts and the USSC to step up and make an actual decision.
There is no question that once this gets back to the USSC, that the option of punting will no longer be in play. Even if Roberts sides with the three liberals, there will still be enough support for an actual ruling to be make. Once that actual ruling is destined to be made, I am pretty sure Roberts will side with the rest of the conservatives, which would lead to at least a 6-3 decision.

Hanen agreed in his ruling with critics of the program who argued that DACA did an end-run around the legislative process by providing benefits to Dreamers without congressional authorization.
Beneficiaries of the program say that in the near-decade since its creation, DACA has allowed them to develop lives in the United States that would have been impossible without some form of legal status.
At the same time, recipients say the program's constant tumult in the courts has caused undue stress, with an ever-present looming threat that the benefits of DACA could disappear at any moment.
Even though the ruling protects DACA holders for now, the prospect of future court proceedings creates more uncertainty for the group.

American Dream and Promise Act of 2021
This bill provides certain aliens with a path to receive permanent resident status and contains other immigration-related provisions.
The Department of Homeland Security (DHS) or the Department of Justice (DOJ) shall provide conditional permanent resident status for 10 years to a qualifying alien who entered the United States as a minor and (1) is deportable or inadmissible, (2) has deferred enforced departure (DED) status or temporary protected status (TPS), or (3) is the child of certain classes of nonimmigrants. The bill imposes various qualifying requirements, such as the alien being continuously physically present in the United States since January 1, 2021, passing a background check, and being enrolled in or having completed certain educational programs.
DHS shall remove the conditions placed on permanent resident status granted under this bill if the alien applies and meets certain requirements, such as completing certain programs at an educational institution, serving in the military, or being employed.
Furthermore, DHS and DOJ shall cancel the removal of certain aliens who had TPS, were eligible for TPS, or were eligible for DED status on certain dates. Such an alien shall receive permanent resident status upon meeting certain requirements and applying for such status within three years of this bill's enactment.
For an alien seeking permanent resident status under this bill, DHS may (1) waive certain grounds of inadmissibility, or (2) provisionally deny the application if the alien poses a danger to public safety or has knowingly participated in certain offenses involving a criminal street gang.
An alien shall have the right to administrative and judicial review of a denial or revocation of permanent resident status granted under this bill. An alien seeking judicial review of a provisional denial shall be appointed counsel upon request.
An alien who appears to be prima facie eligible for relief under this bill shall receive a reasonable chance to apply for such relief and may not be removed until there is a final decision on that application for relief.
DHS may not use information from applications filed under this bill or for Deferred Action for Childhood Arrivals status for immigration enforcement purposes.
DHS shall establish a grant program for nonprofit organizations that assist individuals with certain immigration-related issues.
This bill also repeals a restriction that bars a state from providing higher education benefits to undocumented aliens unless those benefits are available to all U.S. nationals without regard to residency in the state.

The problem with DACA is that it quite literally incentivizes breaking the law. If the parents break the law to get into the country, then they at least know that their kids can stay. This gives illegal parent immigrants INCENTIVE to break the law.
It would be like creating a law that states that anyone who steals can provide that money to their children, so their children can benefit for that crime. The argument being that the children didn't break the law and therefor should be entitled to that money and not see the Government take it away from them. They didn't commit the crime, right?

WASHINGTON — A federal judge in Texas on Friday declared illegal the federal program that has allowed nearly 800,000 young people brought to the United States illegally as children to avoid deportation and remain in the country.

In 2012, the Obama-Biden Administration created the Deferred Action for Childhood Arrivals (DACA) policy, which has allowed hundreds of thousands of young immigrants to remain in the United States, to live, study, and work in our communities. Nine years later, Congress has not acted to provide a path to citizenship for Dreamers.
Yesterday’s Federal court ruling is deeply disappointing. While the court’s order does not now affect current DACA recipients, this decision nonetheless relegates hundreds of thousands of young immigrants to an uncertain future. The Department of Justice intends to appeal this decision in order to preserve and fortify DACA. And, as the court recognized, the Department of Homeland Security plans to issue a proposed rule concerning DACA in the near future.
But only Congress can ensure a permanent solution by granting a path to citizenship for Dreamers that will provide the certainty and stability that these young people need and deserve. I have repeatedly called on Congress to pass the American Dream and Promise Act, and I now renew that call with the greatest urgency. It is my fervent hope that through reconciliation or other means, Congress will finally provide security to all Dreamers, who have lived too long in fear.
