DACA is unconstitutional and now we finally have a court decision saying so

Surprise Court Ruling Lands a Major Blow Against Joe Biden and Illegal Immigration Advocates
Fridays can be full of surprises sometimes, and we got one today regarding illegal immigration. A federal judge in Houston ruled that DACA, the long-challenged and debated amnesty program for illegal immigrants brought to the US as children, is illegal. That was part of a lawsuit brought by multiple states noting the unconstitutional nature of the program. You may recall that the Supreme Court essentially punted on the issue in the summer of 2020 because Chief Justice John Roberts is a coward who decided to focus on how the program was ended instead of whether its original creation (under Obama) was legal or not.
DACA’s illegality has been obvious since the beginning. Barack Obama himself said over and over via public appearances that he did not have the power to do what he did. That was part of his pressure campaign pointed at Congress in an attempt to force through an amnesty bill. When that didn’t materialize, he acted on his own with authority he didn’t have. On the merits, the idea that protective status via “deferred action” can be bestowed upon a certain group of illegal immigrants, thereby bypassing the delegated authority of the legislature, never held any real legal weight. Yet, as often happens with emotionally charged issues, courts, including the Supreme Court, have tap-danced around the issue instead of saying what everyone knows – that DACA is illegal.
Now, we finally have a judge who has put on record that the program is just that. There are also practical ramifications to this, such as DACA no longer being a magnet (at least until some higher court gets involved) for migrants looking to cross the border illegally. One of the most tragic aspects of the “compassion” shown by illegal immigration advocates, including Joe Biden, is that it encourages dangerous, deadly behavior that ultimately enriches the drug cartels.

So this is an important decision for two pretty big reasons. First is that it is in place until another court decides that this judge is wrong.  That puts the ball in the court of DACA advocates (and likely the Biden Administration) to get involved and attempt to have this overturned. Secondly, the fact that there is now a ruling out there that suggests the law is unconstitutional (and everyone knows it is) puts pressure on Roberts and the USSC to step up and make an actual decision.

There is no question that once this gets back to the USSC, that the option of punting will no longer be in play. Even if Roberts sides with the three liberals, there will still be enough support for an actual ruling to be make. Once that actual ruling is destined to be made, I am pretty sure Roberts will side with the rest of the conservatives, which would lead to at least a 6-3 decision.

Another 0linsky declaration determined to be unconstitutional. That happened a lot to the constitutional law professor.

My guess is that Cert won't be granted and the decision of the appeals court will stand.

That's how SCOTUS will tap dance around the issue.

The 5th circuit is fairly conservative so DACA won't survive the appeal.

One thing bothers me is the fact that the Dreamers were born brought across the border as infants. It's not right to send people who may not even speak Spanish, who often have high levels of education, who would be productive members of our Republic.

The U.S. Supreme Court last year blocked a bid by Trump to end DACA, saying that his administration had done so in an "arbitrary and capricious" manner.

U.S. Homeland Security Secretary Alejandro Mayorkas said in March that his department would issue a formal regulation to strengthen the legal standing of the DACA program, but the agency has yet to do so.

Biden's comprehensive immigration bill, which Democrats introduced in Congress on Feb. 18, also calls for a three-year pathway to citizenship for many DACA recipients, but it lacks Republican support and faces long odds of passage.

The Obama administration issued a memo creating the DACA program after a bipartisan immigration reform bill called the DREAM Act failed to pass Congress.

Recipients are protected from deportation, granted work authorization, given access to drivers' licenses, and in some cases have better access to financial aid for education.

Hanen agreed in his ruling with critics of the program who argued that DACA did an end-run around the legislative process by providing benefits to Dreamers without congressional authorization.

Beneficiaries of the program say that in the near-decade since its creation, DACA has allowed them to develop lives in the United States that would have been impossible without some form of legal status.

At the same time, recipients say the program's constant tumult in the courts has caused undue stress, with an ever-present looming threat that the benefits of DACA could disappear at any moment.

Even though the ruling protects DACA holders for now, the prospect of future court proceedings creates more uncertainty for the group.

We are a nation of immigrants.

This may not survive the Supreme Court.

Original intent philosophy doesn't apply here.

Boo Fucking Hoo.

Get the fuck out.

For some unknown fucking reason we're the only country on earth not allowed to have secure borders and secure elections. That shit needs to stop NOW.

Coldheartedtruth Teller said...

Those currently enrolled in the program will not be affected until a further court ruling, meaning they will still be permitted to work and be protected from deportation.

As of March, more than 616,000 people were living in the United States under DACA status, according to government data.

The videos of tens of thousands of people being deported from the United States, if this decision stands, will look like the Jews shoved into railroads and sent to Auschwitz.

This is not the United States of America.

Why not? And who the fuck do you think you are to declare this?

Our country, when founded, was "originally intended" to have the secure borders of a sovereign nation. When did that get suspended?

There is a legal and well documented process to emigrate to America.

Follow it and you are welcome.

But Roger is okay with CRT that suggests racial attitudes of previous generations can be placed on the shoulders of those alive today... even if they, themselves, did not commit those acts or have those attitudes?

How is it Roger that you reconcile this? How is it that children of criminals cannot suffer for their parent's crimes, but great grandchildren of slaveholders apparently should be held accountable for that?

Besides, this thread is not about whether or not DACA is a "good or bad" idea. It's about whether the law is constitutional or unconstitutional. Whether a President has the right to implement something that otherwise would require legislation.

Statement by President Joe Biden on DACA and Legislation for Dreamers

JULY 17, 2021STATEMENTS AND RELEASES

In 2012, the Obama-Biden Administration created the Deferred Action for Childhood Arrivals (DACA) policy, which has allowed hundreds of thousands of young immigrants to remain in the United States, to live, study, and work in our communities. Nine years later, Congress has not acted to provide a path to citizenship for Dreamers.

Yesterday’s Federal court ruling is deeply disappointing. While the court’s order does not now affect current DACA recipients, this decision nonetheless relegates hundreds of thousands of young immigrants to an uncertain future. The Department of Justice intends to appeal this decision in order to preserve and fortify DACA. And, as the court recognized, the Department of Homeland Security plans to issue a proposed rule concerning DACA in the near future.

But only Congress can ensure a permanent solution by granting a path to citizenship for Dreamers that will provide the certainty and stability that these young people need and deserve. I have repeatedly called on Congress to pass the American Dream and Promise Act, and I now renew that call with the greatest urgency. It is my fervent hope that through reconciliation or other means, Congress will finally provide security to all Dreamers, who have lived too long in fear.

Scott, would you support legislation to allow the Dreamers to become citizens, instead of deportation???

The President has said that the Congress has to act.

But I guess that you will oppose it because the President and the Democrats try pass legislation, because they are Democrats.

Whether a President has the right to implement something that otherwise would require legislation.

An executive order would not be the right way forward.

CRT is just another example of distraction

Scott, the filibuster is blocking this legislation that was passed by the house of Representatives.

Shown Here:
Passed House (03/18/2021)

American Dream and Promise Act of 2021

This bill provides certain aliens with a path to receive permanent resident status and contains other immigration-related provisions.

The Department of Homeland Security (DHS) or the Department of Justice (DOJ) shall provide conditional permanent resident status for 10 years to a qualifying alien who entered the United States as a minor and (1) is deportable or inadmissible, (2) has deferred enforced departure (DED) status or temporary protected status (TPS), or (3) is the child of certain classes of nonimmigrants. The bill imposes various qualifying requirements, such as the alien being continuously physically present in the United States since January 1, 2021, passing a background check, and being enrolled in or having completed certain educational programs.

DHS shall remove the conditions placed on permanent resident status granted under this bill if the alien applies and meets certain requirements, such as completing certain programs at an educational institution, serving in the military, or being employed.

Furthermore, DHS and DOJ shall cancel the removal of certain aliens who had TPS, were eligible for TPS, or were eligible for DED status on certain dates. Such an alien shall receive permanent resident status upon meeting certain requirements and applying for such status within three years of this bill's enactment.

For an alien seeking permanent resident status under this bill, DHS may (1) waive certain grounds of inadmissibility, or (2) provisionally deny the application if the alien poses a danger to public safety or has knowingly participated in certain offenses involving a criminal street gang.

An alien shall have the right to administrative and judicial review of a denial or revocation of permanent resident status granted under this bill. An alien seeking judicial review of a provisional denial shall be appointed counsel upon request.

An alien who appears to be prima facie eligible for relief under this bill shall receive a reasonable chance to apply for such relief and may not be removed until there is a final decision on that application for relief.

DHS may not use information from applications filed under this bill or for Deferred Action for Childhood Arrivals status for immigration enforcement purposes.

DHS shall establish a grant program for nonprofit organizations that assist individuals with certain immigration-related issues.

This bill also repeals a restriction that bars a state from providing higher education benefits to undocumented aliens unless those benefits are available to all U.S. nationals without regard to residency in the state.

President Ronald Reagan said...

Now, tomorrow is a special day for me. I’m going to receive my gold watch. And since this is the last speech that I will give as president, I think it’s fitting to leave one final thought, an observation about a country which I love.

It was stated best in a letter I received not long ago. A man wrote me and said: “You can go to live in France, but you cannot become a Frenchman. You can go to live in Germany or Turkey or Japan, but you cannot become a German, a Turk, or a Japanese. But anyone, from any corner of the Earth, can come to live in America and become an American.”

Yes, the torch of Lady Liberty symbolizes our freedom and represents our heritage, the compact with our parents, our grandparents, and our ancestors. It is that lady who gives us our great and special place in the world. For it’s the great life force of each generation of new Americans that guarantees that America’s triumph shall continue unsurpassed into the next century and beyond. Other countries may seek to compete with us. But in one vital area, as a beacon of freedom and opportunity that draws the people of the world, no country on Earth comes close.

This, I believe, is one of the most important sources of America’s greatness. We lead the world because, unique among nations, we draw our people — our strength — from every country and every corner of the world. And by doing so we continuously renew and enrich our nation. While other countries cling to the stale past, here in America we breathe life into dreams. We create the future, and the world follows us into tomorrow.

Thanks to each wave of new arrivals to this land of opportunity, we’re a nation forever young, forever bursting with energy and new ideas, and always on the cutting edge, always leading the world to the next frontier. This quality is vital to our future as a nation. If we ever closed the door to new Americans, our leadership in the world would soon be lost.

A number of years ago, an American student traveling in Europe took an East German ship across the Baltic Sea. One of the ship’s crew members from East Germany, a man in his 60s, struck up a conversation with the American student. After a while the student asked the man how he had learned such good English. And the man explained that he had once lived in

He said that for over a year he had worked as a farmer in Oklahoma and California, that he had planted tomatoes and picked ripe melons. It was, the man said, the happiest time of his life.

Well, the student, who had seen the awful conditions behind the Iron Curtain, blurted out the question, “Well, why did you ever leave?” “I had to,” he said. “The war ended.” The man had been in America as a German prisoner of war.

Now, I don’t tell this story to make the case for former POWs. Instead, I tell this story just to remind you of the magical, intoxicating power of America. We may sometimes forget it, but others do not. Even a man from a country at war with the United States, while held here as a prisoner, could fall in love with us. Those who become American citizens love this country even more. And that’s why the Statue of Liberty lifts her lamp to welcome them to the golden door.

It is bold men and women, yearning for freedom and opportunity, who leave their homelands and come to a new country to start their lives over. They believe in the American dream. And over and over, they make it come true for themselves, for their children, and for others. They give more than they receive. They labor and succeed. And often they are entrepreneurs.

Equal enforcement of the law according to the alky -

Last summer, federal officials in Delaware investigating Hunter Biden faced a dilemma. The probe had reached a point where prosecutors could have sought search warrants and issued a flurry of grand jury subpoenas. Some officials involved in the case wanted to do just that. Others urged caution. They advised Delaware’s U.S. Attorney, David Weiss, to avoid taking any actions that could alert the public to the existence of the case in the middle of a presidential election.

“To his credit, he listened,” said a person involved in the discussions, reported here for the first time. Weiss decided to wait, averting the possibility that the investigation would become a months-long campaign issue.

The problem with DACA is that it quite literally incentivizes breaking the law. If the parents break the law to get into the country, then they at least know that their kids can stay. This gives illegal parent immigrants INCENTIVE to break the law.

It would be like creating a law that states that anyone who steals can provide that money to their children, so their children can benefit for that crime. The argument being that the children didn't break the law and therefor should be entitled to that money and not see the Government take it away from them. They didn't commit the crime, right?

You want the "current" group of people protected under the law to stay. I say fine. You want to continue to make it policy moving forward to allow incentives for illegals with parents to cross the border, then you are simply pushing and applauding and encouraging crime.

Scott, Axios has an answer to your questions. It might not stand.

A federal judge ruled on Friday that President Obama did not have the legal authority to create the Deferred Action for Childhood Arrivals (DACA) program, which offers protection from deportation for immigrants brought to the U.S. illegally as children.

The latest: Calling the ruling "disappointing," President Biden on Saturday urged Congress to "ensure a permanent solution by granting a path to citizenship for Dreamers that will provide the certainty and stability that these young people need and deserve."

"I have repeatedly called on Congress to pass the American Dream and Promise Act, and I now renew that call with the greatest urgency," Biden said, adding: "It is my fervent hope that through reconciliation or other means, Congress will finally provide security to all Dreamers, who have lived too long in fear."

Why it matters: The U.S. District Court for the Southern District of Texas ordered the Biden administration to cease approving new DACA applications but specified that the decision would not affect current recipients for now.

The decision followed a challenge to the program filed by the attorneys general for nine Republican-led states, including Texas, who argued that DACA was improperly adopted and financially burdened them by making them pay for DACA recipients' education and health care.

What they're saying: U.S. District Judge Andrew Hanen held that the creation of the program violated the Administrative Procedure Act, which governs how federal agencies develop and issue regulations.

"To be clear, neither this order nor the accompanying injunction requires [the Department of Homeland Security] or the Department of Justice to take any immigration, deportation, or criminal action against any DACA recipient, applicant, or any other individual that it would not otherwise take," Hanen wrote.

“This ruling is wrong and is subject to appeal," Omar Jadwat, director of the ACLU's Immigrants’ Rights Project, said in a statement.

"But Dreamers’ futures shouldn’t be in the hands of the courts. It is absolutely urgent that Congress acts now through the budget reconciliation process to provide Dreamers and other undocumented members of our communities with reliable status and a pathway to citizenship.”

The big picture: Congress has for years tried to pass a legislative solution that would allow DACA recipients to live permanently in the United States, but those efforts have repeatedly failed.

"[T]he court takes no position on how DHS (or Congress, should it decide to take up the issue) should resolve these considerations, so long as that resolution complies with the law," Hanen wrote.Senate Democrats hope to tie key immigration reforms to the next budget reconciliation package.

What's next: Biden said that the Department of Justice will appeal the decision to the U.S. 5th Circuit Court of Appeals and the Department of Homeland Security will "issue a proposed rule concerning DACA in the near future."

Reagan allowed millions of illegal immigrants to apply for citizenship.
