Here is an interesting question...

Given the FBI went to Mar-a-Lago previously. Given that they were allowed to search the documents in question and apparently were there for several hours. Given that they found and took approximately half of the 300 documents in question. 

How is it that they missed the other half of those documents? 

Moreover, Considering that the FBI was asking for the storage locker to have new locks installed, and asking for the video feed outside the locker. It seems pretty obvious in retrospect that they "knew" that they left documents behind? 

How is it that they missed the other half of those documents? 

Now obviously the former President of the United States was not going to personally go through boxes and boxes of materials that were packed up (for him) and shipped (for him) to this location. Certainly the FBI had to know that he was not going to go through these boxes personally, especially after the FBI had spent hours previously going through them?

How is it that they missed the other half of those documents? 

It is not like there were "new" documents being put there. Every box of documents were there for the FBI to have gone through previously. The boxes they went through on the 30 agent raid were the same boxes that the FBI previously went through?

How is it that they missed the other half of those documents? 

When they got a warrant to go back and perform their armed raid of the ex-President's home they had to have shown good cause that they were sure that documents were there? But if they were so sure that the documents were there after previously searching for them (and apparently finding many). 

How is it that they missed the other half of those documents? 


Does anyone have a good explanation for this?  

Because it's almost as if they purposely left documents behind.

A new report is shedding light on exactly how the DOJ investigation into Donald Trump over supposed “classified documents” at Mar-a-Lago got started. The FBI recently raided the former president’s Florida home, claiming possible violations of the Espionage Act and other national security concerns.

What flowed after the unprecedented action was a series of coordinated leaks from inside the government meant to make Trump look guilty of crimes. But how did things get that far?

Apparently, it started with the National Archives, which is run by a partisan hack who decided to treat Trump differently from all other presidents before him. For Trump, though, the National Archives didn’t even give him a year before running to the DOJ to push for a criminal investigation.

While they claim "today" that they are under "their control" the actual reality is that they struck and agreement with Obama giving him several years to digitalize the 33 million documents. The National Archives has no physical control over the documents. That is a general play on semantics.

Again... no records on the National Archive site as having a "warehouse" in Chicago. They have a national archives "center" there and the website explains exactly what is there and what can be viewed. But it is not a warehouse, it is not big enough to store 33 million items and it does not suggest that they have anything to do with any records for Obama.


This is a semantic argument where NARA is claiming to have taken control of Obama's records that are stored in a warehouse in Chicago. Again...when a President leaves office they remove their own records. Obama did what Trump and every other President did when they left office. They packed up their records and took them with them.


and yes... for those of you wondering. The person in charge of the National Archives is a partisan actor.

But he did have some very effective policies, in all areas. I don't really want another term of all the arguing and fighting. Trump ask for a special master to look through the seized materials to determine the relevancy to the underlying affidavit and warrant. Their job is to make sure the FBI is not looking at anything that is irrelevant to their original search. The design is to prevent so called "fishing expeditions" where the FBI just grabs a bunch of materials and looks through it all hoping to find something that is not in the warrant.

I guess I have to question the legitimacy of anyone claiming to both a legal expert but not understand what a special master is? I mean if "I" know what it is... then why the hell would a real lawyer not?
I would also question the idea that the "judge" did not know what to make of the request of a special master.

These are not unusual... and quite frankly "REAL" attorneys like McCarthy and Turley are "baffled" by why the DOJ did not appoint one themselves right off the bat, why they didn't appoint one when asked previously by Trump.

In other words real attorneys believe that the Trump filing asking for a special master is not just reasonable but should have already been done by the DOJ without having to be asked.

Most feel that the Judge should grant the request.

If it is not granted, then there will be an appeal. Eventually grown up people might end up take a look at this (USSC).


But as McCarthy has suggested from the start... this is a fishing expedition and the refusal to appoint a special master is more proof of that.

People close to Donald Trump worried that the former president was getting himself into legal trouble, weeks before the FBI raided Mar-a-Lago to seize official White House documents, according to a new report from The Washington Post.

Since June, about a month after the National Archives and Records Administration notified Trump's team that federal investigators would begin reviewing a batch of records that were returned at the beginning of the year, Trump's attorneys feared a mounting legal disaster for the former president.

One person in Trump's circle said "Mar-a-Lago is a big problem," according to The Post.

Trump and his attorneys knew the FBI was about to get involved with the documents debacle since April, based on a May 10 letter between the National Archives and Tump's attorneys.

Debra Steidel, acting archivist for the National Archives, told Trump's lawyers, including Evan Corcoran, that she would allow the FBI to review the batch of documents Trump returned in January, following weeks of delay.

"It has now been four weeks since we first informed you of our intent to provide the FBI access to the boxes so that it and others in the Intelligence Community can conduct their reviews," Steidel wrote.

Trump's attorneys previously asked for more time to review the documents to see if any of them fell within the purview of executive privilege, according to the letter.

However, Steidel wrote that the assistant attorney general has helped determine that "there is no basis for the former President to make a 'protective assertion of executive privilege.'"

"I have therefore decided not to honor the former President's "protective" claim of privilege," Steidel wrote. "For the same reasons, I have concluded that there is no reason to grant your request for a further delay before the FBI and others in the Intelligence Community begin their reviews."

FBI officials would raid Trump's Mar-a-Lago home on August 8. The letter revealed that Trump had taken more than 700 pages of classified documents.

A spokesperson for Trump did not immediately respond to Insider's request for comment.

The motion, in that regard, appeared to concede that Trump violated one of the criminal statutes listed on the warrant used by the FBI to search the former president’s Mar-a-Lago resort – 18 USC 2071 – concerning the unlawful removal of government records.

So you actually believe that a "fishing expedition" which is basically legal slag for an abuse of the 4th amendment... is "justified"?

Search warrants are never ever legally supposed to grant a fishing expedition. The entire point is to limit a search to the specific items listed in the warrant. Which is why the "Special Master" was necessary from the beginning and the refusal to grant one might come back to bite them.
