2) They were recovered by a filter team, which weeds out privileged info.

The DOJ by saying items were improperly collected has also inadvertantly admittedly stated that its evidence collection process was tainted and conducted improperly. Thus placing all collected items suspect and challengable for court use.

Monday evening Politico reported that FBI agents had taken Trump’s passports – swept them up unintentionally. The passports were found by a “filter team” that goes through everything that was confiscated to ensure items like privileged attorney-client communications are not assessed or included as part of their investigation.
The FBI notified Trump’s attorneys they had the passports, telling them they could pick them up.

The problem was that nearly every liberal media outlet immediately accused Trump of lying about the FBI seizing his passports. How dare Trump accuse the white hats in the FBI of something so nefarious!

Now, Trump has found himself on the other end of an Espionage Act investigation. (President Joe Biden’s Justice Department authorized a search of Mar-a-Lago that cited the Espionage Act in its justification, but no charges against Trump have been filed yet.)
Unlike most of the people charged with the Espionage Act under the Trump administration, except perhaps Schulte, Trump’s theft of classified documents wasn’t aimed at exposing attacks on democracy, shining a light on government atrocities, or adding anything newsworthy to the public discourse.
In their allegations, authorities have not offered any explanations about Trump’s motives for retaining classified documents on his way out of the White House in 2020. Knowing Trump, it wasn’t anything altruistic. We do, however, know that Section 793 of the Espionage Act carries a maximum sentence of 10 years in prison.
The Biden DOJ and FBI is attempting to select the Republican Canidate for 2024.

It seems like the Biden Justice Department is telling the court what to do. Respectfully, the court should make its own independent assessment of the compelling public interest in transparency about this abusive raid. The ‘criminal investigation’ the Biden administration is covering up reeks of corruption and dishonesty – and is based on a reinvention of law about presidential records that is at odds with the U.S. Constitution, court rulings, federal statutes, and prior government legal positions and practice. No administration should be able to raid the home of a former president and putative presidential candidate based on ‘secret’ reasons.
The U.S. Constitution and federal law give unreviewable authority to President Trump to take whatever records he wishes at the end of his presidency. The Biden administration’s dishonest depiction of personal records of President Trump it illicitly seized during the raid as “classified” is further demonstration that the raid was a brazen act of raw political abuse.

It was the day the FBI blew up its own reputation and America’s rule of law. The deed was done on orders of an uber-wealthy little man with a grudge, Merrick Garland, Attorney General for the United States, and with help from Christopher Wray, head of the Gestapofied FBI. An oversized armed raiding party of American Stasi put their jobs ahead of doing the right thing – which would have been to refuse to do it. They are without excuse.
For politics’ sake, Garland and Wray and a petty magistrate judge in Florida jumped aboard the Let's Lynch Trump Again Train and joined the 6-year-long effort to destroy a former president of the United States, now a private citizen.
